Conspiracy Revealed?

Sixteen months after the Jason Daskalos DWI diversion from APDs paddy wagon, we finally found out who is accused of conspiring with former Officer Ben Kirby. Of course, the whole conspiracy thing didn't show up until fourteen months after the incident and just coincidentally right after Kirby filed a wrongful termination lawsuit against the city (read about it here).

According to our Eyes, Officer Matt Fisher is the officer being accused of conspiring with Kirby to release Daskalos. Interestingly enough, Daskalos himself isn't being investigated for his role in the whole affair. It seems as if the DA's office is treating Mr. Daskalos - who was under arrest at the time - as an innocent victim even though he was the one escaping at the time.

As we've said before, this whole thing has been kind of strange. Daskalos was arrested for DWI; he is then taken on a field trip from the DWI paddy wagon, returned to the paddy wagon, booked on DWI, tried for DWI, and ultimately acquitted. As you all know, Officer Kirby was fired for his role; but what gets us is that the DA initially chose not to prosecute but fourteen months latter ended up deciding to begin a grand jury investigation that didn't involve Daskalos.

Seemingly, the conspiracy is revealed and those who conspired are APD rank and file officers. To us this just doesn't add up. Two APD officers decide - on their own - to bust Daskalos out of DWI custody with no orders from above and no indication of any personal ties to Daskalos himself.

Folks, it doesn't take a genius to figure out that there's a lot more to this story and that we'll probably never know what really took place August 25th, 2006.

Wow....How can Daskalos not be charged with anything? Oh yeah, his family has bucks and they buy their way out of everything! So once again Zorba the Geek (oops, I mean Greek)goes free. And isn't he trying to sue Jason Otzenberger for something?

I feel for Officer Fisher, Didn't they already do an IA on him...Why now are they doing a GJ.

Matt Fisher is a fine officer and a very active , vocal , Board Member of The A.P.O.A. When the newspaper ads sponsored by the A.P.O.A were released rumor has it that Ray Ray swore he would get Fisher. Well guess what. Sixteen month later. Continuing the Grand Jury to ensure the outcome that Ray Ray wants. CORRUPTION IS AT THE TOP. THIS IS A HUGE COVER UP. CITIZENS BEWARE. TYRANNY !

Speaking of conspiracies, why haven't we seen or heard anything about Brad Winter cutting a deal to stack the Water Board with anti-growth socialists in order to become council president?

Look at his appointments. There's no question that's exactly what he did. Good news? his wife won't divorce him now.

The Sheehan Law Firm that represents the City, and which Nann Winter is an attorney, does not set policy for the City. Their job is that of representation, period. As for appointments and deals; the alternative would have been much worse. You should be thankful that Councilor Winter is the President of the Council and not a puppet of Marty(Stalin) Chavez, and Ray (Himmler)Schutlz.
Oh, on a side note, Nann Winter is a very bright, intellectual Councel to the otherwise academically deficient leadership of this city. The citizens should be damn thankful that at least in the interest of water, we do have the best and the brightest representing our best interests

Let me say first hand, Matt is a terrific officer.... Ok people make mistakes... (ray ray and marty you dont count, i know)....

The whole thing is a scam and I hope both ben and matt have attorneys waiting to file a lawsuit... where does it stop for them?

I heard that it was Nick Bakass who ordered Kirby to set the jail bird free. Where is the indictmetn for Backass and for Daskalos?

If this has ANYTHING to do with people with money or polical power; I am sure Marty Chavez has something to with it to. Where the indictment on him?

They make all other city employee's place them on vehicles, but they don't have them on theirs?????????

I don't know, if I get pulled over, and get popped for dwi, and then we hang around the bat mobile for awhile, and then the cop tells me "you know what? Go on home." I'm hauling ass outta there before he changes his mind. And I'm also not asking questions. And I don't care who pulled strings, made calls, threatened, cajoled, or coerced. I am just outta there.
(I....on the other hand wouldn't have been dwi in the first place and if I did get a lucky break, which is how I would see it at that point, then I wouldn't do it again. I think that's gonna be too much to ask for our boy Jason.)

Yeah, but on the other hand, if another officer sees you haulin' ass away from there, follows you home and you run and hide inside your house like a scared rabbit, don't be surprised if he trips your car alarm in order to flush you out then takes you to jail where you belong. Oh yeah, also you'd probably be charged with running from the police felony evasion, etc. That is of course, unless you're Zorba the Geek,then you'd hire a scumbag lawyer and all your charges would go away!

Why don't you just chalk it up as a dumb ass mistake and let the time off serve as his punishment? Bring Kirby back with time served, no back pay and make him sign off on any intent to sue. That would be too easy though, everyones out for blood until it's them that made a bad decision.......?????????

In light of the last 3 years within APD (DUI officers WITH DUI's,RAPE,Direct TV Scam,Theft of guns, money, and drug's at the evidence room, the wife/mistress beaters etc. etc. etc.) why don't you chalk it up as a dumb mistake? Let me guess you never make/made one? I bet you are one of those guys that yells the loudest about others transgressions. Have you ever taken a Free or half off breakfast/lunch or dinner? That would be against APD policy. Shouldn't you be fired for it? Like the poster a few up said it was a dumb ass mistake. We're all human and make human mistakes. Kirby just F'ked up really, really, bad BUT he deserves another chance. Good officers=APD could use some--Kirby was basically a good one, except for a transgression that probably happenend because he was doing something that someone wanted him to do....someone with a lot of power who doesn't have the 'nads to come out and admit it!

If it is a rule its just that a rule if you break it you should face the same punishement as everyone else. But you are perfect. I see you have no problem excepting a cup of coffee for free? There is a rule for a reason. If I give you a thousand cups of coffee for free what will you give me in return? By the way that little food for half off seems petty doesn't it? Well how about the movie theaters, car washes, and all the other little things you are not supposed to except? Hit a nerve didn't it? You make a good wage and shouldn't be prostituting "Your Badge" for half off/free anything. Gotta' go lier my shift at IHOP is about to start......! P.S. We give half off to fat, lazy, piss poor tippin' APD officers.

Hahahha-ever tryin getting a free cup of coffee @ Starbucks? Just kidding!! - serously, no one forces officers to accept the discounts that stores offer. Like the 10% off during the holidays at furniture stores, or the Jiffy Lube 10% discount, video stores, etc. On the other hand if an officer wants to accept the discount, don't you think that's their business? The offer was made to them so the choice is theirs. So quit cutting each other up, it's just a choice an officer has to make,that's all.

Ahhh your missin' the point...? It's against APD policy for them to except ANY form of REMUNERATION. No it is not their choice. I am simply pointing out how one officer makes a bad choice and gets fired and a bunch of officers break the rules no matter how petty or small and it's looked past as O.K. .....? I have to say that the Police Department has changed dramatically in the last 19 years. What happend with progressive discipline and learning from your mistakes to become a better cop. These days you are fired for mistakes that everyone has made in the old days. I would bet that APDs adminstators have driven a friendor relative that was DWI home a time or two. Remember dont throw stones from a glass house. APD is falling apart from inside out. Bring back the unity among the officers and quit separating them. You will find a much safer city with happier officers.
