Department of Justice Seeks Input From Citizens

As we all now know, the US Department of Justice announced a formal and comprehensive pattern and practice investigation is under way into the Albuquerque Police Department’s violations of federal law and the Constitution. (http://www.justice.gov/crt/opa/pr/speeches/2012/crt-speech-121127.html)

For approximately two years, the specter of the DOJ coming in and investigating APD has lurked in the minds of officers on patrol, citizens stopped by officers, and community members demanding change in city council meetings. But we at the Eye know that nobody more than Ray Schultz and RJ Berry have been thinking about what it means if the DOJ were to come in and investigate the department. It would mean Failure. And Mr. Schultz and Mr. Berry want us to believe they have done everything they could to keep this from happening.

From Darren White’s grandstanding of having the Police Executive Research Forum (of which Mr. Schultz was a board member) evaluate the department to the Matrix Consulting Group’s operational analysis to Mr. Schultz’s own personal ideas, the results of these efforts have been the addition of layers and layers of “things” thrust upon APD personnel. Thinking there was too much of paramilitary culture in APD, Mr. Schultz changed the department’s once lauded academy to one that holds academics over duty and deprioritizes discipline and order. Thinking all incidents involving officer and citizen contacts needed to be video recorded, Mr. Schultz deployed lapel cameras on officer but has concealed disfavorable video. When caught with misconduct by deputy chiefs illegally using their cellphones at crime scenes, he had the phones replaced in violation of court orders.



At today’s press conference Mr. Berry and Mr. Schultz revisited these lies and added more. They stated they themselves realized there was a spike in officer involved shootings and not the outcry of the community. They stated that they are engaged with the community for ideas despite ignoring the community groups that pack every city council meeting. They said APD is leading the way in the deployment of new technology, while Mr. Schultz stands there without his own lapel camera on and while Mr. Schultz failed to follow his own SOPs during his alleged NM State Fair arrest. They said they have adopted and followed all of DOJ’s recommendations over the last two years, yet here DOJ is. They stated that crime rates have fallen when in fact they have risen. Mr. Berry stated we “have had a community dialogue” yet at every point of controversy the mayor has evaded, denied, redirected, or just admitted ignorance to the issues presented to him.

When confronted with these lies, a reporter asked Mr. Berry if this action by the DOJ will be a “black eye on the City,” Mr. Berry evaded the question and did not answer it. The fact is, despite all of these superficial changes to APD by Mr. Schultz and Mr. Berry, they have remained in charge of APD. It is because of their failures that APD is in such a crisis that the DOJ must now come in to undue the mess they have created. While editor Ken Walz and his paper, the Albuquerque Journal, opined that Mr. Schultz is the “right man for the job” (Albuquerque Journal, 9/2/11) it seems they were wrong once again. And their blind endorsement of a man totally out of his depth in his ability to lead a major city department will be costly. DOJ’s actions will have significant economic effects as this is much more than a black eye upon the city but the state as well. Mr. Berry and Mr. Schultz’s failures have not only tarnished a once fine department but they have tarnished the city’s economic future.

Assistant Attorney General Perez stated that DOJ’s investigation will not be limited to incidents of force by APD officers but will be an investigation into the “totality of the circumstances.” Perez stated that in these investigations every door leads to rooms with other doors, and ominously added “sometimes there are trap or hidden doors….[w]e will peel the onion to its core, and leave no stone unturned. We will follow the facts wherever they lead us.”

Assistant Attorney General Perez was very clear in wanting information from the community regarding the investigation of APD. “We invite anyone with information to email us at community.albuquerque@usdoj.gov or call our community voicemail box at  (855) 544-5134, which is available in English and Spanish.”

Schultz fails to step up again. He did not say "I am chief and I take full responsibility." That's not nor has is ever been Ray's style. But he and his worthless command staff are why DOJ is here. What was the first thing Ray did now Doj is here? Release a confidential list of 34s, most of whom have done nothing wrong. Another poster nailed it, brass will do everything they can to hang this on rank and file. No contract, no chief, no honor, no unity. (And I won't even comment on the absence of our worthless Apoa folks).

I for one am finally glad to have this investigation underway. The morale of the rank and file have dropped to an all time low. Leadership in the department is hard to find and when you find a sgt, lt or cmd (if any) with a set of them and actually supports their troops you see them get targeted over and over till they fade to black.

The APOA is nothing now. The membership does not care because we see lack of support and a lack of will to fight from the executive board. To get support from the membership we need to see new blood in the office and a fight from them, till then your "organization" will lack any teeth.

Maybe the DOJ will come in and sweep out the load of shit that is brining down this department. To all who serve, keep doing your jobs eventually the storm will clear.

Since Ray is posting officers on the watch list, how about he post the names of officers and command staff that have cost the city millions in lawsuits. Start with RAY SCHULTZ $900,000 for the Costales case. Then you can add to that all the command staff listed as adulters in the Levi Chavez Case. I want to see that list. Ray doesn't have the courage to post it.

Gary King, If you read the Eye please make a motion to remove Ray Schultz from the NMLEA Board.

The DOJ investigating APD is proof enough that Ray is not running his department and therefore should not be reviewing other officers certification. This would hold Ray accountable for his horrible leadership and horrible management of APD.

Hold him accountable and remove him from the state law enformcement board.

I loved it when Alex Tomlin asked Ray if he should step down. Ray looked like Bill Clinton when asked about Monica Lewinski. I almost heard Ray say, HOW DARE YOU ASK ME IF I AM TO BLAME.

1) A person with a known criminal history and is in the process of committing a crime and is holding a weapon is a potential threat to the safety of Officers and the public.

2) The Police encountering dangerous situations that can turn deadly real quick need to rely on training. For example, A Police Officer needs to keep up to date
with target gun training. A Police Officer that can aim better at a leg or arm would be less likely to kill. Increased weapons training with the intent focused on taking down a man holding a gun without killing that individual.

3) Increased awareness on weapons training. For example, a man holding a knife vs. a man holding a gun. A man holding a gun seems to be more probable in causing immediate harm than a man holding a knife. There can be more discretion in what type of weapon to use. For example, a man holidng a knife can be taken down with the "beannie bag." The beannie bags have enough force that from a safe distance can be utilized.

3) Contolling anger toward offender after offender has been taken down. Police brutality caught on tape is disgusting. More training on controlling emotions of anger toward the offender. For example, training on the impact of offender psychology. Crime occurs due to poverty, narcotics vs crime due to seriel killer, psychotic.

The Journal and other news media constantly continue to spread the lies put forth by Schultz about officers Doyle and Woolever, using the same inflamatory slanderous alegations. It's going to be a shame for Schultz along with everyone involved in that investigation when the DOJ finds out what was done to those officers, and the illegal actions done by those who did it. Those investigators omitted witneses and evidence and tampered with witnesses. The IA investigator is on tape stating that the officers actions would have been justified had Chief Schultz not hidden the fact that Doyle knew who Blume was then changes his statement and lies at Doyle's arbitration hearing. Doyle and Woolever actually showed that deadly force does not have to be used just because it's justified when hands on is sometimes more effective. I really think the media is going to eat a whole lot of crow on this one. Give it a break already. The media was obviously present at Doyle's arbitration yet omit all of the lies and embarrassing discrepancies, omissions, foolish contradictions, and fabrications put forth by the city. Damato Law discredited all of their witnesses. It is all over for Schultz and gang when the DOJ talks to Doyle and Woolever and the truth gets out. Who's squirming now Ray? Maybe you should take the 5th when the DOJ comes to talk to you. I heard Peck's partners are testifying against him.

If you have ever dealt with an individual hopped up on drugs and adrenalin or mentally deranged, you would know that less lethal's effects are drastically effected and diminished. It's called a bean bag gun. Why would an officer use a bean bag shotgun when someone is shooting at them with a real gun? Would you expect soldiers to fight a war with bean bags?

You really need to do some research.
Look up caliber press and see just how fast a knife wielding suspect can advance on you, and stab the shit out of you. Look up Force Sciences Institute and see just how fast an armed suspect can kill you from a position that seems totally harmless and at a disadvantage.

Unless you have been there you really need to shut your mouth. The more uneducated people are about force and it's use the more foolish they sound.

I am not advocating deadly force by any means. It is a case by case issue and every one is different. Alot of times deadly force CAN be averted by other common sense choices a little courage, and less fear of going hands on. But if you want that you better accept the fact that hands on isn't pretty either. Law enforcement is a brutal profession. Officers are constantly in danger while in uniform. The mere fact of that uniform says I'm here, I have a gun, I'm a visible target to the bad guys. The bad guy instantly knows who the officer is. The officer doesn't have a clue who teh bad guy is. Advantage... Bad guy. This is why ambushes on officers usually result in officer deaths. Unless you live your life every day in a profession like that, you really need to shut your mouth with the Monday morning quarterbacking.

One last thing: When officers are fighting for their lives it's going to appear brutal. It's not a video game. People are going to get punched, kicked, kneed, and elbowed. It will look like anger. Don't be concerned with what it looks like. Be concerned with WHAT IT IS. Look at the whole picture. There is more to a video than the video itself. The totality of the circumstances are just as important, if not more important.

I'm not trying to be a dick. Hopefully this opens your eyes to a little reality. God knows APD has a chief who is trying to alter in every day. Don't feed into his lies. He is the problem here. He uses his officers to cover up his corruption. The DOJ will see this.
Keep an open mind, and listen to all sides. Hopefully officers and citizens will all benefit from the DOJ ridding the corruption at high levels.

Why is it ok for the Department to let the business partnerships use City email to encourage people to contact DoJ if they have positive stories to share? Isn't that the equivalent of using City resources to lobby?

Yeah right, they are so constantly in danger that in 200 years, less than 20 cops have been killed and very few were fighting for their lives. You have never been in a fight either, you sound too scared to me. And cops are not soldiers, don't even compare, soldiers really fight for their lives. COPS ARE SUPPOSE TO KEEP THE PEACE. Everyone deserves to be alive and go home to their families at the end of the day..not only the Cops, the citizens as well. Cops are paid to protect and to serve white, black, brown and red...sane and insane, rich and poor sick and healthy. Whether they are homeless or live in mansions. And especially our troops, who really fought for their lives so, that(cops like you or wanna be cops like you) can kill them here at home. You are right, citizens are not the enemy, but when they cross the line and they escalate the force continuum then officers have the right to protect themselves and stop the threatening action. If they are in the wrong, then the investigation will show that. The previous poster is right, police officers are targets. But I guess from what you are saying these officers didn’t fight for their lives.

All APDs shootings have been cleared by a grand jury. Not sure why you think APD officers are shooting people in the back or on the ground. They have all been deemed justified by regular citizens serving on a grand jury. Yes every citizen deserves to go home. You about summed it up. You put it all in perspective. I have never seen a place full of so many tactical wannabees who have lost touch with basic police work. It wasn't long ago that you only had a gun, baton, and handcuffs on your belt, yet a whole hell of alot less people were shot. Now you have cops with bat utility belts full of so many trinkets that their pants are falling down, and they still have to pull over two blocks enrout to a person with a gun call to break out their AR15's and drop leg mag pouches when someone needs the police there. I don't know how many times I have seen officers stop their cars enroute to that hot call, to suit up like they are going to Afganistan. You are right, this is unacceptable. Our job is to protect, mitigate losses and injuries if it is in progress, and get there fast. This crap is being taught, and it is bullshit. This television fantacy bullshit needs to go. And God forbid you don't drink their tactical Kool Aide. God forbid you want to get to the scene to help people. Now you are deemed unsafe because you aren't in the tackleberry club.

Any other hands on approach type scenarios I was told were unsafe, and you will be disciplined for it. Now this chief wants to promote alternative methods. BULLSHIT. He is the problem here. There has been a culture at APD where you do it our way or it's the highway for way too long and as much as officers say they don't Monday morning quarterback eachother, that is bullshit too. They can't talk enough about eachother behind eachother's backs. This includes when an officer uses another method besides deadly force to get the job done during a deadly force situation. I don't know how many times I have heard officers run their mouth's "Oh that is unsafe... They are going to get hurt" and so forth for not doing it the club's way.

It's all going to come to light my friend. All of it. They can deny it like they always do, and they can bring in their bullshit witnesses whom they coached and told what to say all they want, but everyone is in tune with their antics. Everyone knows they are liars. The more similar stories come to light, the more everyone is going to see the truth. And the stories are going to be told.

Are you going to tell us that one recent payout for 4.25 million was a justified shooting when an officer shoots a kid that is laying on the ground after he has already been shot through the back? Maybe you would like to tell us why officers involved in that case were deemed liars on the stand, and Giglioed and that now their testimony is worthless.
Maybe you would like to explain why. Please tell us why this kid was shot when he did not have a gun.

Please explain why a tactical officer who is trained to identify a target, would shoot someone with a spoon from a safe vantage point.
Exigent circumstances is bullshit. A spoon is not imminent danger of seriously bodily harm or death.

APD is in this situation because the chief picks chooses what he wants to do. HE does whatever he wants, and when he fails someone else takes the fall and the city pays for it after he lies his ass off.

The karma is just beginning.

APD now hires Officers who are scared to be on the street because when hired they are promised to be put inside as soon as possible to keep them out of harms way. Want examples?

Look at your PIO who worked 6 months of graveyard in Tanoan and got scared.

Look at the brand new Officer in vice who was also scared of the streets so they put her safely out of uniform.

Look at the one in IT who fixes computers cause she broke a fingernail on a call and cant work the streets anymore.

What bout the ones who have been on forever hiding like Nadine, and Deirdra. And lets not forget the daughter of the restaurant owner who hides out in plain clothes driving by pawn shops making sure they have clearly lit open signs.

Oh there's plenty more hiding inside that you could ever imagine. The only good thing about them being inside is they are so tiny that being on the streets would force them to use deadly force before going hands on anyways.

The street cops need help on the streets! Send the PIO's, computer geeks, and Pawn shop lurkers back to the streets!

Increase manpower chief and disband all those useless positions. I can fix my own damn computer, and tell the media no comment.

There are way too many closets in the Main. They all need to be opened, emptied and fumigated... The field is so short calls are holding and the officers are exhausted.. Get all the rehires wherever they are assigned out to the field. Isn't that why they were rehired in the first place? No more of the choice slots for rehires... The rehires are not special they are not OWED anything..... And don't get me started on ALL THE WORTHLESS FEMALE 34's out there...

Please let's not forget all the civilian police employees who have lived through the rath of Schultz and his cronies. I retired after being a model City employee for over 28 years. Six of those working at the police department. I suffered and I mean suffered through years of personnel board hearings and court proceedings. I was not given due process afforded to me by the consititution. I won two personnel board hearings (same case) and then the City asked for clarification of wording. Again, the board was in my favor. The Police Department appealed and it went to District Court. Again, Judgement was in my favor. But the police department and city legal ignored the judges order. So, my attorney filed a civil action and was preparing for trial. Several weeks before the trial started, the City offered me a settlement. Was it worth my health, my sanity and my career? No amount of money is worth it. Not only do the sworn suffer, but also the civilians. I hope the DOJ looks into the civilians whose civil rights have also been violated.

I agree with the post about all of the "cops" hiding inside, out of uniform and out of harms way. This department has civilian personnel (PSA's, FET's and Admin Assistants) who have seen more field time and written more reports than most of these so called "cops". There wouldn't be a shortage in the field with all of the upcoming retirements if these officers would put their uniforms back on and do what they are getting paid to do. Serve and Protect. You don't need a gun and a badge to talk to the media. You don't need a gun and a badge to tackle a computer virus. And you don't need 6 inch stilettos to combat crime. Twenty years ago, this department was something to be proud of. The Albuquerque Police Department of today is a joke. Unfortunately the clowns outnumber the few hard working Officers who are left. And to those Officers I say, Thank you for your hard work and for the great job you do each and every day. It's unfortunate this department is looked at as a whole. Because these few hard working officers deserve more than the reputation their Mayor, Chief, DCOPS and fellow officers have bestowed upon them.

As a citizen I have mixed feelings about the DOJ investigation. I realize officer moral is down and there is a great divide between leadership and officers. But has anyone read any of the DOJ reports from their other police department investigations? I just read the East Hampton report. I'm not sure that APD officers want that kind of outcome. I realize each investigation is different, but it appears to me that EHPD had bad leadership, but focuses their findings and recommendations on the officers, not leadership. It sounds like you all are in for alot more training and scrutiny. Who knows...good luck to you all, this city is a mess.

@6:59 we'd welcome it. Right now,as the Eye reported, we have a boss who writes great job and signs his name to it, then fires you and tries to get you arrested for the thing he said great job for. And it's happened more than once. Rather you agree with the shootings or not the SOP clearly states discipline will be handled case by case. As in if your friends with the right people problem solved. Sure he'll cite the code of sanctions but go read the other part about he has ultimate decision. He likes to make everyone pre determination hearing go before him so he can "look them in the eye".... Back when you were looking all your friends in the Eye who were later convicted of the Courthouse scandal, how'd looking them in the eye work out for you?

This investigation will sully the reputation of officers not the brass. It has happened in most of DOJ investigations. The families of the shooting victims don't care either way they just want someone blamed .....it will be the officer. Not to burst everyones bubble but mark my words it will go down that way. The restaurant serves great food, is loved by many in our community, and contributes to our local economy as a small business. Needless to say, I am PROUD to be the daughter of the restaurant owner you speak of in your cowardly anonymous post. I am also a PROUD employee of APD.

I am also PROUD to be a woman who contributes to keeping our city safe daily. Now that you know my name, please feel free to pull my physical assessment stats, shooting range qualification scores, check with the horse mounted unit, auto theft unit, organized crime unit, special investigation division (vice and narcotics) and you can see that as a woman I am more than qualified to be part of the APD. My history with the department also proves that I do not hide or run away from field assignments. I can still take calls for service. Please take a break from your miserable day and make the time to realize that women are equal to men. I’d hate to think that I was responding to a woman. That would be disappointing.

I don’t read Eye on Albuquerque because it is filled with rumors and lies by individuals who would rather talk about people than take an active role by working and assisting those in our community who we are charged with serving. The taxpayers would appreciate APD employees to be part of the solution, not part of the problem. Please note that I wrote this reply on my personal time, not the taxpayers time.
