As our regular readers know, we are strong advocates of Constitutional rights and support the protection of personal liberties. For some time, our Eyes have been keeping us posted on the city's political office: the Real Time Crime Center. AKA the RTCC.
We cannot think of a greater local threat than the RTCC to our right to be free of unregulated government spying and intrusion. As our Eyes have told us, Perry/Berry routinely use the resources held by the RTCC for purposes other than it's stated mission: "Provide real-time information to field officers responding to high-risk calls."
You see the director of the RTCC is none other than former Albuquerque Journal police reporter Todd "TJ" Wilham:
Even though TJ has no experience running an intelligence unit (let's be real, that's what the RTCC is and among their activities is data mining), he does seem to qualify for one thing. He's a political hack. And don't take our word, or our sworn Eyes word for it. Here's confirmation from the city in their response to an recent IPRA request (or more accurately, an IPRA of IPRAs):
So TJ Wilham is a political appointee huh. He's has no law enforcement training, is not a sworn officer (that is took an oath of office and swore to uphold the law), was originally hired by Darren White as his public information officer, and then when shown walking papers was yet another person given preferential treatment by his Tasergate uncle, Ray Schultz. (If the pattern of Schultz giving underqualified people overpaid positions isn't clear enough, this takes the cake. Let's not forget former APDrs Karen Fisher and Karen Salazar either).
So Schultz places TJ in position where there is no oversight and from what our Eyes tell us, he routinely is doing research on citizens unrelated to field officers responding to calls. But rather, he is doing favors for Berry/Perry (and just how disconnected from Darren White is he?). And as the city confirms, TJ has no job description. And apparently is untouchable from being complained about by citizens. Really?
A political appointee using privileged and public department resources outside the scope of the unit's mission? We see that the RTCC has been nourishing for TJ:
But this stinks more like Josef Goebbels. Not in American do you do this TJ. Perhaps Mr. Heh and Mr. Dinelli should know, or demand to know, what public resources TJ used in support of the Berry campaign or continues to use.....

Yes Eye, let's show the media connection and conspirators involved with Schultz. Now this is what needs to be investigated. Personal cell phone? SOP states the City will turn over all call and text logs when a personsl phone is used for City business.

"The ACLU, which has been trying to pry open the details of this relationship for years, is still hammering away, focusing on a recent case out of Florida.
As revealed in a recent opinion of a Florida appeals court, Tallahassee police used an unnamed device — almost certainly a stingray — to track a stolen cell phone to a suspect’s apartment. (The case’s association with stingrays was first pointed out by CNET’s Declan McCullagh in January). They then knocked on the door, asked permission to enter and, when the suspect’s girlfriend refused, forced their way inside, conducted a search, and arrested the suspect in his home. Police opted not to get warrants authorizing either their use of the stingray or the apartment search. Incredibly, this was apparently because they had signed a nondisclosure agreement with the company that gave them the device. The police seem to have interpreted the agreement to bar them even from revealing their use of stingrays to judges, who we usually rely on to provide oversight of police investigations.
When the suspect’s lawyer tried to ask police how they tracked the phone to his client’s house, the government refused to answer. A judge eventually forced the government to explain its conduct to the lawyer, but only after closing the courtroom to the public and sealing the transcript of the proceedings so the public and the press could never read it. Only later, when the case was heard on appeal, did the most jaw-dropping fact leak out. As two judges noted during the oral argument, as of 2010 the Tallahassee Police Department had used stingrays a staggering 200 times without ever disclosing their use to a judge to get a warrant.
Potentially unconstitutional government surveillance on this scale should not remain hidden from the public just because a private corporation desires secrecy. And it certainly should not be concealed from judges. That’s why we have asked the Florida court that originally sealed the transcript to now make it available to the public. And that’s also why we have asked police departments throughout Florida to tell us whether they use stingrays, what rules they have in place to protect innocent third parties from unjustified invasions of privacy, and whether they obtain warrants from judges before deploying the devices."
"Mr. Wilham is a political appointee." Interesting they would use this language. Under city personnel rules and regulations, city personnel fall under two categories: either "classified" with vested rights and can only be fired for cause or "unclassified/exempt" meaning you are at-will and can be terminated without cause, any time. All the Mayor's Department Directors for example, including Chiefs of Police and Fire, are unclassified/exempt and serve at the pleasure of the Mayor and can get fired at any time. There are also hundreds of other unclassified or exempt positions at City Hall where people are usually replaced when a new Mayor is elected, BUT NOT anymore. Also, after a person works for 5 years they become vested for retirement. For the last year Rob Perry and Berry have gradually and deliberately made a number of exempt/unclassified positions as classified thereby protecting their political appointees if Berry lost the election. Rob Perry and Berry have also been giving 10 to 15% raises to Department Heads and Assistants all the while offering rank and file 1% to 2% raises. Just compare Department Director salaries today to what they were being paid 4 years ago. Which now brings us to TJ Wilham. TJ Wilham was making about $45,000 if not less than that as a Journal reporter. He was one of Darren Whites media buddies and it was White that got TJ his job when he ordered Schultz to hire him at $75,000 a year. TJ's position when he originally stated was an unclassified/exempt position and he has been trying to get the job classified so his retirement will be vested on one year and where he cannot be easily fired.

QUALIFIED IMMUNITY: AN OVERVIEW
“Qualified immunity balances two important interests—the need to hold public officials accountable when they exercise power irresponsibly and the need to shield officials from harassment, distraction, and liability when they perform their duties reasonably.” Pearson v. Callahan (07-751). Specifically, it protects government officials from lawsuits alleging that they violated plaintiffs’ rights, only allowing suits where officials violated a “clearly established” statutory or constitutional right. When determining whether or not a right was “clearly established,” courts consider whether a hypothetical reasonable official would have known that the defendant’s conduct violated the plaintiff’s rights. Courts conducting this analysis apply the law that was in force at the time of the alleged violation, not the law in effect when the court considers the case.
Qualified immunity is not immunity from having to pay money damages, but rather immunity from having to go through the costs of a trial at all. Accordingly, courts must resolve qualified immunity issues as early in a case as possible, preferably before discovery.
Qualified immunity only applies to suits against government officials as individuals, not suits against the government for damages caused by the officials’ actions. Although qualified immunity frequently appears in cases involving police officers, it also applies to most other executive branch officials. While judges, prosecutors, legislators, and some other government officials do not receive qualified immunity, most are protected by other immunity doctrines.
Recently, in Pearson v. Callahan (07-751), the Supreme Court held that courts considering officials’ qualified immunity claims do not need to consider whether or not the officials actually violated a plaintiff’s right if it is clear that the right was not clearly established.

Another innocent man in jail for almost 4 years for a murder he did not committ.
It takes the jury 2 hours to find him innocent. APD and the District Attorney defend their actions. No one in Albuquerque gives a damn. He will sue and we will pay, dearly.
How many times does this have to happen before something changes at the District Attorney Office and at APD? How many innocent people spend years in jail because Ray Schultz, Richard Berry and Kari Brandenburg are incompentent? When will these three be held accountable for the innocent lives ruined by the agencies (and city) they run? When will we start holding them accountable?

As Senator John McCain has said "elections have consequences". Berry was reelected and city personnel and APD rank and file are all screwed for another 4 years. Going after TJ is an exercise in futility and he is secured as long as Berry and Perry are around. The Eye needs to focus on much bigger corruption and targets at City Hall like Rob Perry and other department heads like Eden who once discredited will have an impact on Berry's popularity. Berry's ultimate goal is to be Governor or US Senator and TJ is nothing but a pimple on Berry's ass. Rob Perry on the other hand is the second head of the Berry snake and Berry's hatchet man.

Les Brown stands by his vice detectives in the Pat Murdoch case. He says "they did a very thorough investigation", then in the very same interview when asked about the possible extortion claims against the woman in the case against Murdoch along with Murdoch's allegations of theft of over $10,000 worth of items from his home by this woman, what is Lieutenant Brown's response? He didn't know if those claims were "fully investigated." Do these people listen to themselves speak and how badly they publicly contradict themselves every time they open their mouths. This is more proof of the culture within APD of omitting anything from a case that may hurt their preconceived outcome. Then what does lieutenant brown do? He throws state appeals court judge Michael Bustamante right under the bus by making sure he points out that he reviewed and signed the search warrant on the Murdoch case. Well.... Many search warrants were signed that were based on bad information provided by officers. The judge relies on officers to provide good information. And besides, the search warrant is only a piece in this puzzle.
Notice the pattern here. Omitted facts, biased investigations, then the blaming of others when caught. It was a shit case and if the brass would for once stand up and admit for once that they fucked something up, things would start to change. But as you can see they continue to point fingers and deny.

Let's be clear about this shooting. Sandy arrest of Murdoch gets thrown out. Within the same week, with CIT on scene, Sandy fires his weapon and the guy dies. Sandy is not CIT but he took the shot. He is also not SWAT. He is the guy who was fired from State Police.
If BLT had baggage that resulted in ten million, good shot or not, this guy had no business in the field THIS week. Any attorney will get the jury to open the checkbook bigger then we have seen. Add to it the pending jury verdict in Torres that everyone is waiting to see and this is another bad payday.
Once that is done how many other cases will appeal and win? All that's left is for attorneys to realize how many cases had both of these two working on them.

Brown clean house before the attorneys get every case thrown out. Even a first year can now toss every case you produced and will until you make drastic changes.
Someone needs to look into the connection between Murdoch and 1st DA Spence - a very messy case involving the same suspects that they were prosecuting in both cities, that include snitches for both police depts. How convenient to make it her call to prosecute him. What message does the mishandling of Murdoch send to other sitting judges???

I am hearing Peck will be facing some untruthfulness, purjury and witness intimidation issues in the very near future. Someone rolled on him during all of this DOJ business. It's ironic how he followed right in the footsteps of another winner, Ryan Buckner.

I dont believe the info on Peck is true. I dont know him but if it was true i think he would be pulled to desk duty. Who knows it could be correct information but if DOJ has reason of wrong doing, they would iuld demand a desk fir him
@10 APD does not sideline the golden boys of Ray. It promotes them. When DoJ is done they will make sure everyone, not just Peck, that they know about doesn't have a desk or a badge.
