Double Standards

We here at the EYE have been watching The New Mexico Secretary of State Duran, saga play out.  First when accused of embezzling campaign funds she disappears for three weeks with pay (Maybe she was out playing the slots again). Then she gets a formal indictment and in a short time returns to work.

We are told by our Eyes that our State Representatives will decide what to do about her in the near future. We do not think not much will happen; after all, aren't there other State Officials being looked at for the same thing?  Are these same people who will be apart of the politicians who will decide Duran's fate?

Now let’s look at the Police. Here are just a few examples, there are many, many more. Orlando Comacho, fired from A.P.D. found not guilty in a Court of Law.  Doyle and Woolover both fired despite both State  and Federal Investigations found no crime and no charges brought. Sandy and Perez indicted; Sandy retired  and Perez was fired. Pablo Padilla, indicted and fired.  But let us not forget Chief Ray Schultz.  Our EYES tell us there was a complaint filed with The New Mexico Attorney General well over a year ago reference Taser Gate and nothing has happened.  What are they waiting; for the statute of limitations to run out?  We don't claim to know the guilt or innocence of anyone. We mainly point out the DOUBLE STANDARD.  The police are always accused of covering up for one another; the word “police” should be replaced with the word “politician.”

Schultz Assures Levy Witness will have "Sudden Dementia or Alzheimer’s" when Testilying

The Eye On Albuquerque received the letter below and a very incriminating record.  Berry; you and Schultz are on your way out.  The Governor’s Organized Crime Unit should be listening to the recording and the Democratic Attorney General, Gary King, should be investigating this case.

I am writing you this letter anonymously because I fear retaliation and have personally seen retaliation done to other individuals, both sworn and non-sworn employees. To name a few would be Sam Costalas, Al Walck, Brad Ahrensfield and Orlando Camacho. I want to remain anonymous because I have a family to care for, have put in my time, will be retiring in a few years and can’t risk losing my livelihood.  However, I cannot stand by and continue to see the destruction of what was once a great police department that seems to have been destroyed by Ray Shultz and the people he has promoted. Ray is not a Chief or a leader and seeing him attempt to make himself look better than others (Steve Tate and Dan Klein) in his recent Journal article pushed me to do this letter.

When it comes to recording another person or persons, the New Mexico State Law allows a recording provided there is one consenting party. Attached is a recording between Ray Shultz, Kathy Levy, me and others. I have edited the audio to cover up the laughter of certain individuals and myself in fear of retaliation. The conversation discusses sworn testimony given in a deposition that was given by Retired Captain Rob DeBuck (now rehire officer Rob DeBuck) in a lawsuit regarding Orlando Camacho vs. City of Albuquerque. During the conversation, they discussed how angry DeBuck was at Camacho and then the conversation mocks DeBuck.

-Kathy Levy: I said it then, I’ll say it now, I’ll say it in the future and (in the background someone say’s “Oh nooo”) I’ll say it in court and it’s all on the record…

-there’s laughter and a noise to hide certain voices

-Kathy Levy: It will be funny if he gets on the stand and says, “I didn’t say that, that was never my belief.”

-Ray Shultz: I can make sure he gets a sudden case of dementia or Alzheimer’s (with Ray laughing at the end of his statement)

-Kathy Levy: That’s pretty much what I would want.

The attitude taken in this conversation is nothing a City Attorney or Chief of Police should be carrying on about. Making sure a certain witness testifies in a certain way is acting more like a Drug Kingpin than a Chief of Police. Isn’t witness intimidation also illegal? How about perjury? Because of this type of behavior the City of Albuquerque has lost over 44 million dollars last year alone. Police officers such as Sam Costales sued due to retaliation and won a million dollars and due to such behavior, Shultz used close to $200,000 of the tax payers money to remove his name from the lawsuit. Kathy Levy approved the amount and was very well aware of how much money the city lost in the lawsuit. Mayor Barry has continued to keep Ray Schultz around after he has been found guilty of violating his own officers’ civil rights. Hopefully there will be a new mayor, and hopefully the new mayor will appoint a new chief that will pursue criminal charges against Ray, Kathy, Perry and others for their criminal antics.

The Eye On Albuquerque agrees completely with this person; criminals need to be criminally prosecuted. We need a solid leader in the Mayor’s office. We need a leader like Paul Heh; a proven leader with a proven past of dignity, honesty, integrity, ethics and crystal-clear open government.

Is There Even One Honest Person on the 5th Floor of APD?

Here is an open letter to the Eye. It details all the lies and SOP violations that were committed by APD’s Deputy Chief, Paul Feist. This Deputy Chief lied to the media when he was interview by KRQE Channel 13 which mean that he lied to you; the public. It’s no wonder Feist lies so much since he was raised by Ray Schultz. We have said it many times here on the Eye; corruption starts at the top and trickles its way down.

Good Evening Eye,

My name is Orlando Camacho, the former APD officer that you did a
story on regarding the shell casing that was returned to me by APD
Evidence and also KRQE did a story on KRQE (Read it HERE). I am
writing to you tonight because after I saw the KRQE story about Deputy Chief
Feist, I found out by APD releasing the casing to me, they
violated procedures and regulations regarding the handling of evidence
and I filed a complaint with the Independent Review Office.

Today I received the attached letter from the IRO stating that due to
the fact I retrieved the evidence in April of 2012 and filed my
complaint in November 2012 it was past the 90 days of the incident and
their office has no jurisdiction to conduct a further investigation
in the matter and inactivated my complaint without further
investigation. Also, in my complaint, I stated Deputy Chief Feist
lied in the KRQE interview stating the shell casing was released
as a result of a court order and should also be investigated. I
never had an attorney file any kind of injunction with the courts to
have the city release my items. Nor, did I file any sort of paperwork
on my own behalf with the courts for my items to be released.

The way I see it, by Feist lying, he violated several operating procedures:

1-04-4 W. Personnel shall truthfully answer all questions
specifically directed to them, and narrowly related to the scope of
employment and operations of the department. (Truthfulness)

1-04-1G Conduct unbecoming an officer or employee shall include:
1. That which could bring the department into disrepute; or

2. That which impairs the operation or efficiency of the department.

1-04-1 F. Personnel shall conduct themselves both on and
off-duty in such a manner as to reflect most favorably on the
department

1-02-2 D. Use of discretion by sworn personnel
during the performance of their law enforcement
duties.

1. When sworn employees of this department are faced with a
situation where discretion can be exercised, they must evaluate the
circumstances, consider the available resources, and rely on their
training, department policies, department procedures, statutory law
and supervision in making the appropriate decision.

2. In addition, within each situation, the appropriate
decision should be the least restrictive that still accomplishes the
intent of the law, is in accordance with department policy, and does
not compromise officers' safety.


These same operating procedures when violated by other officers,
especially 1-04-4W Truthfulness, is an offense that usually results in
termination or the officer having to resign instead of being
terminated. I'm not here to sound like a cry baby, the reason I'm
contacting you is because this is another clear example of the current
APD administration picking and choosing who gets disciplined and who
does not and it needs to be brought to the public’s attention. Please

This statement by Hammer (below) clears the way for every single officer to get an investigation quashed rather they are right or wrong. Here you go Police Union. The City deserves what they get…

Here are a few questions; is there ANYONE on the 5th Floor of APD that doesn’t lie constantly? If a high ranking officer can boldly lie why isn't it okay for every officer to lie? We Think the answer to the first question is; there is not one. The answer to the second question is "NO!" Lying is a bad thing; a thing Feist should have been FIRED for period. Feist is suppose to be setting the correct example for the rank and file. It is time to vote in a Mayor who can and will do the job. Berry needs to start counting down the days till his departure.

Good evening,

My name is Orlando Camacho and I am an ex-apd officer. You may be familiar with what happen to me while an officer with the Albuquerque Police Department. Tonight I write to you because of something that has happened to me and I find with great disrespect, anger, insulting, a low blow and slap in the face for the upper command staff of the Albuquerque Police Department, especially Deputy Chief Fiest. I may have the emotions because I am directly involved with this incident and you may or may not feel the same emotions that I do.

I was involved in a struggle for my firearm with a person that I saw as a father. During that struggle, the firearm discharged and fatally wounded my dad. A casing ejected from the chamber of the Glock and was later found underneath the left knee of my dad. I was later terminated from the department without being charge with any crime. Later indiated for 2nd degree murder charges and was acquitted and won a ruling that Chief Shultz had violated my civil rights due to the method that he handled my termination. Years after this occurred I went to evidence to retrieve some items that were tagged as safe keeping. I had a little bit of a struggle with people return my phone calls and trying to get my property back. At one time, I was told that Deputy Chief Fiest had to sign off on releasing my items. I had to call him a couple of times to check the status of my items being released since he oversaw the evidence. I was contacted that Fiest did release my property.

When I picked up my property, one of the items I found was the casing involved in the struggle with my dad. I have attached photos of the evidence bag, tag and casing. This was a slap in the face and insulting for the department to release this to me. Call my incident what you would like, an officer involved in a shooting or an officer in a shooting, this casing was evidence in a homicide and should of never been released and should have been kept in evidence. Does the department do this with other major cases? The last officer involved shooting was involving Sgt Peck, will he be given the casing back from the shot that he fired?

As I stated, I may be seeing this as a bigger issue than you. But please understand, the intentional act of them giving me this casing was wrong. I wanted to share this information with you but also I fear some sort of retaliation.
