Mary Han Part III: Shades of White

The above statement came from Darren White and his campaign on October 15, 2008, prior to being beaten by then city councilor, and now U.S. Senator, Martin Heinrich. White made the remarks as then state senator pro-tem Manny Aragon plead guilty to charges of conspiracy and mail fraud in a public corruption case which brought down the once mighty politico.
 

Two years later, White himself would be in the center of orchestrating the greatest and most macabre police cover-up in APD's history. In it White would be promoting the desecration of a crime scene, tampering with evidence, lewd acts of voyeurism, grand theft, obstruction of justice, conspiracy, and the cover-up of the murder of one of Albuquerque's most high profile and successful civil rights attorneys.
 

The call to APD Dispatch came in at 12:35 on November 18, 2010, and in it Ms. Han's former partner and rejected state supreme court justice Paul Kennedy reported an "accidental suicide." Kennedy stated to the dispatcher that he had gone by to check on her because she had not gone in to work that day. Instead of the silver Mercedes convertible Kennedy is known to drive, he arrived at the scene in a black Range Rover. But 911 is not the only call Kennedy made.
 

As the city's Public Safety Director, Darren White received a call, that his records indicate as being from an "Unknown Caller" moments later, White made a flurry of calls to City Attorney Rob Perry, to his own PIO TJ Wilham, to APD Deputy Chief Allen Banks, and to APD Chief Ray Schultz. From there those persons called other familiar names in Albuquerque's current affairs including then APOA President Joey Sigala, APD Deputy Chief Paul Feist, Assistant City Lawyer Kathy Levy, APD PIO Trish Hoffman and other unidentified persons including an APD detective.
 

As this mob of scoundrels descended upon Ms. Han's residence, the first responders were rapidly displaced by a never ending parade of stars and suits. DCOP Allen Banks and DCOP Feist went into the house and removed all first responders. Their actions, and the actions of others, remain inexplicable to this day. In the course of their actions triggered by White's flurry of phone calls, a crime scene was destroyed by people who had taught and overseen crime scene training and instruction. A scene was invaded by onlookers that seem to show a flurry of data transfers (that we are sure can be pinged to the cell towers near Candelaria/Rio Grande) which can only mean images were sent away. When those images and/or phones were "replaced" evidence of the scene was also tampered with and destroyed by the very people who provide instruction and oversight to thousands of city employees. And then there are the diamond rings.

Were they too tempting of a trophy for the offenders?

Or were they articles of nostalgia for one boxed into a corner by years of nefarious actions, unrequited love and bold rejection?

New Mexico Attorney General's Report: Part 1

The release of an official findings report from the New Mexico Attorney General regarding the Albuquerque Police Department's response to the unattended death scene of successful civil rights attorney Mary Han once again brings the incident to the front page and lead story of local media.

And again APD makes national news of yet another failure so egregious, the department is known from coast to coast as one of the worst law enforcement agencies in the country.

Over the next few days we are going to scrutinize APD and the city's handling of this matter in thorough detail. As we have been routinely monitoring the initial incident, the department's response, the actions of high profile public and private persons, and more, we at the Eye are confident in saying this sad affair not only challenges the very legitimacy of APD, but many of the city and state's current leaders. Our Eyes have kept us updated since the date of the original incident and we have indeed made some all but certain and definitely relevant connections which occurred prior to November 18, 2010.

We start at the end however. Today we look at the city's (and defendant) and Bank's response to the AG's letter.

The New Mexico Attorney General functions as the state's chief legal officer and legal counsel to state government, consumer advocate, and guardian of the public's general interest. It has civil investigative divisions as well as criminal divisions and has jurisdiction state wide. It is staffed with attorneys and certified law enforcement officers. Regularly the NMAG is asked to review incidents or conduct its own investigations into high profile matters that are beyond the scope of the local agency or appear to need an objective review.

These review are commonly known as opinion and advisory letters. Citizens, towns, cities, counties and the state use these opinion letters to guide actions. Think of them as robust legal analysis that give one an almost certain idea of where an issues stands. This past Friday, the NMAG issued its objective and independent review of APD's handling of Ms. Han's death scene and the report confirmed much of what is already known: That APD deviated from standard law enforcement protocols, state SOPs, and internal SOPs that its actions were simply disgraceful. In fact the actions of APD and city leadership were described as “inappropriate,” “terribly mishandled,” “inexplicable,” and “fundamental police procedures for suspicious deaths were inexplicably not followed.”

What does this mean? It means that nothing that APD claims to be true at the scene, can be considered true.

When confronted with these findings, APD and the city of Albuquerque's leaders confirmed the report by simply not challenging it. They do what all people guilty of acts do, they attack the accuser. But in this case, the accuser are the people of New Mexico.

Instead of addressing any of the findings at all in the AG's report, APD's interim chief, Allen Banks jumped on creating a comparison between the AG and the FBI. Banks remarked that the FBI "did receive all the information."

When asked about the NMAG inquiry, Banks added,

"the Attorney General has not reached out to us. If he has additional information, um or evidence, then yes, reach out to us we'd be more than happy to work with him. I stand behind the investigation of the Albuquerque Police Department. I also stand behind the investigation of the state office of the medical investigator. I'm kind of surprised and perplexed at the way the Attorney General sent out a news release and has not contacted the Albuquerque Police Department.”

We at the Eye find that answer bizarre. It sound like what many of our Eyes hear when they arrest an offender and that offender cries that the arrest is bad because some other offender got away with the same incident on another occasion. It doesn't even make sense. Perhaps Banks didn't understand that the FBI was working in conjunction with the NMAG?

Following up those statements came this response from the office of David Tourek, the city attorney for Albuquerque:

"Mary Han's death was investigated by the independent, professional and non-political state Office of the Medical Investigator, which was on scene and reached its own conclusion based on scientific findings. Our understanding is that the FBI was asked to review this case and found no evidence to support additional investigation.”

This of course was in follow up to a statement by city lawyer, Kathy Levy on 11/9/12:

"We've reviewed the lawsuit and it does not state a cause of action under the New Mexico Tort Claim Act. The complaint is factually inaccurate. We are confident the court will dismiss the complaint."

While we appreciate the science that technicians in the OMI are expected to use, by now we've all heard the disgusting biased sexist comments offered by the forensic pathologist who examined Ms. Han. Dr. Reichard may have forgotten about New Mexico, but we have not forgot about him...

In essence, Banks and the city have conceded to the higher authority of the NMAG. And they are attempting to distract us all by attacking the messenger. Which of course not only will backfire, but will make things much worse for them.

Liars Again: This Case has it all; COPS, LYING, SEX, and MURDER

In case you missed it, here's a repeat of a major event that is unfolding in the Levi Chavez trial. On March 16, 2012 we broke the story (READ IT HERE) about how APD's current Deputy Chief Allen Banks was caught lying while under a sworn oath to tell the truth when he was testifying in the labor hearing involving former APD officer Russell Perea.

We also partnered up with other folks to make sure that audio got spread out on the web: Listen to it (HERE).
 

Not surprisingly, we heard another wave of threats about how the 5th and 11th floors were going to take your lovable Eye out. But since these recordings are public record and can be obtained from the city's Administrative Hearing office, and well, are simply the truth, our little terrorists in city power did what they always do....fade away in the night.

Now to be clear, we never supported Russell Perea as a person. It seems there are some very suspicious discrepancies in his account of what he and fellow officer Levi Chavez were doing at the time they were working together that fateful Saturday night in October of 2007. We were critical of APD's efforts to unlawfully terminate an employee. We remain highly critical of Schultz, Banks, and Feist's inability to do the right thing even when it was so obvious there was a coverup for Levi's whereabouts when he was at work. They were so pathetic it almost seems they tried to bungle the termination. And when then hearing officer Zane Reeves overuled the termination, Rob Perry did what Rob Perry does when he doesn't get his way: fire people.

Interesting fact: The murder of Tera Chavez occurred in Los Lunas; Russell Perea worked for Los Lunas Police Department before lateraled over to APD. Hum...Levi Chavez was a lateral too who left Rio Rancho and is in default for the cost of training.

Now Mr. Perea is doing everything he can NOT to testify for his buddy Levi Chavez. How weird is that. One year ago he argued he and Levi were simply working a DV call together where one tagged evidence and wrote the report while the other booked the suspect over a course of a few hours. NOW Mr. Perea is asserting his 5th Amendment right not to self-incriminate himself...

Weird.

DISGRACE; EVERY CITIZEN SHOULD BE REPULSED

On November 18, 2010, supervisors and civilians who had absolutely no authority or duty flooded Mary Han's home with no purpose other than to contaminate the scene, gawk at the deceased and make sure it would not be investigated for what it was; Murder.

The following personnel did not have any bona-fide, legal or legitimate reason/business for being at Han's residence. Their actions violated human dignity, morals, ethics, virtually every SOP, standard and practice for handling unattended death scenes and for that, we at the Eye strip them of their rank and post their identities as drawn from the recent lawsuit:

It really doesn't matter if you personally liked or disliked Ms. Han.  This women was about business when she was in court. We at the Eye know Ms. Han was a tireless advocate of Constitutional Rights, especially the First Amendment's protection of Free Speech. May those responsible for her death and those co-conspirator's that covered up the scene be brought to swift justice.

It is heart-wrenching that the Police Department's top cop and his top subordinates would disrespect the dead.  Since Darren White was the Public Safety Director and Rob Perry was the Chief City Attorney; they should have known and stoped this disgraceful debacle.  We here at the Eye do not believe that you can get any lower than disrespecting the dead, with the exception of being a pedophile.

Of interest, Paul J. Kennedy (who should be a suspect or at a minimum a person of interest in Han's murder), was appointed to the New Mexico Supreme Court by Gov. Martinez.  Did our Governor do her homework like most attorneys or was this another decision made by  Matinez' lead person, Jay McCleskey?

This is a letter from a former APD officer. This is clearly proof of how unethical Berry's Chief of Police, Ray Schultz really is...More to come on this matter.

Good evening,

My name is Orlando Camacho and I am an ex-apd officer. You may be familiar with what happen to me while an officer with the Albuquerque Police Department. Tonight I write to you because of something that has happened to me and I find with great disrespect, anger, insulting, a low blow and slap in the face for the upper command staff of the Albuquerque Police Department, especially Deputy Chief Fiest. I may have the emotions because I am directly involved with this incident and you may or may not feel the same emotions that I do.

I was involved in a struggle for my firearm with a person that I saw as a father. During that struggle, the firearm discharged and fatally wounded my dad. A casing ejected from the chamber of the Glock and was later found underneath the left knee of my dad. I was later terminated from the department without being charge with any crime. Later indiated for 2nd degree murder charges and was acquitted and won a ruling that Chief Shultz had violated my civil rights due to the method that he handled my termination. Years after this occurred I went to evidence to retrieve some items that were tagged as safe keeping. I had a little bit of a struggle with people return my phone calls and trying to get my property back. At one time, I was told that Deputy Chief Fiest had to sign off on releasing my items. I had to call him a couple of times to check the status of my items being released since he oversaw the evidence. I was contacted that Fiest did release my property.

When I picked up my property, one of the items I found was the casing involved in the struggle with my dad. I have attached photos of the evidence bag, tag and casing. This was a slap in the face and insulting for the department to release this to me. Call my incident what you would like, an officer involved in a shooting or an officer in a shooting, this casing was evidence in a homicide and should of never been released and should have been kept in evidence. Does the department do this with other major cases? The last officer involved shooting was involving Sgt Peck, will he be given the casing back from the shot that he fired?

As I stated, I may be seeing this as a bigger issue than you. But please understand, the intentional act of them giving me this casing was wrong. I wanted to share this information with you but also I fear some sort of retaliation.

Caught Lying (AGAIN)

Several days ago our Eyes broke the story about how Albuquerque Police Chief Schultz and Deputy Chief Feist committed egregious violations of department procedural SOPs by releasing officer lapel camera video of the recent officer involved shooting prior to the completion of the investigation. Now KRQE-13 has filed a lawsuit against the city for the APD’s violation of the Inspection of Public Records Act (IPRA) stemming from an incident back in May 2012. You see, reporters routinely request copies of video and audio footage recorded by officers and that material is subject to the IPRA. In this case, it seems there is some controversial footage that APD does not want released to the public despite the fact they have no protections in this case to withhold it. Our Eyes tell us the video involves a suspect who is surrendering and gets Tazed anyway. The department and the city have asserted because there is an on-going investigation into the officer’s conduct, they have an exception to the IPRA requirements. The chief attorney for the city of Albuquerque, David Tourek, stated:

“The City is withholding the video at this time under the law enforcement records exception of the Inspection of Public Records Act due to the fact that law enforcement is currently interviewing witnesses in a criminal case. The release of the video prior to their statements being taken could compromise what they say and the integrity of the investigation. Upon completion of the investigation, the full video will be released."

Excuse us? Did Chief Schultz and Deputy Chief Feist not just release video footage of an officer involved shooting just days ago? Was that video not released before the completion of the criminal investigation? Were the statements by Chief Schultz and Deputy Chief Feist of such detail and particularity because they were spoken before all of the witness interviews were completed the integrity of this latest shooting is now completely compromised? And from being compromised has APD not just once again failed the officers who were involved in this latest dangerous incident AND compromised the criminal investigation against the heroin dealers who were the targets of the original investigation? Are Chief Schultz and Deputy Chief Feist going to be held accountable for actions monumentally against the city’s interest and in direct conflict with the City’s Chief Attorney Tuorek and the City’s Chief Administrative Officer Rob Perry?

The media and other bloggers, Joe Monahan in particular, wonder why all the states around New Mexico seem to have their economies revitalized and growing in prosperity while stagnation runs rampant in Albuquerque and most of New Mexico. Could it be that when hypocrisy is this gross and obvious it impedes any hope or optimism? If they lie about the simple policy regarding videos, what else will they lie about? If they choose to violate state statutes like IPRA, what else will they violate? Of course Mayor Berry is nowhere to be seen in this, for that would require leadership. We’d say it could not be more obvious that the leaders of APD are out of control and are not interested in doing what’s right but only in evading responsibility for their mess. But our Eyes tell us, it is going to get worse. And the citizens and businesses are clearing enduring fatigue from this on-going miscreant behavior by many of the state’s leaders.

P.S. We at the Eye wish to congratulate former Officer Tank Guenther for being cleared of all of the heinous charges brought against him. We applaud the Santa Fe county District Attorney, Angela Pacheco, for dropping the criminal action against Mr. Guenther. Of course APD was quick to terminate Mr. Guenther for the unsubstantiated felony charges. But now, as Mr. Guenther ponders the effort to restore his name with the department, PIO Officer Robert Gibbs asserts that Mr. Guenther was not fired because of the charges but because of “administrative issues.” We at the Eye would like to know what exactly those other “administrative issues” are because our Eyes tell us, no other issues were asserted during Mr. Guenther’s Lauder mill hearing. Could it be that once again, APD’s Chief Schultz is caught lying???
