Free For All or is it Free for Some But Not All?

One of today's top stories on Channel 4 involved the alleged battery on an abortion protester. It was not the story in particular that opened our Eye; it was, however, the statements given to Channel 4. The Eye could not help but question the hypocrisy of the statement of one of APD's Public Information Information Officers, Officer Robert Gibbs. This is what Channel 4 quoted:

"APD officer Robert Gibbs said ultimately, it comes down to Shaver's right to free speech.

"He was exercising his free speech that we are all allowed to with the First Amendment. That doesn't mean you
can get up and hit somebody or batter somebody," Gibbs said."

This comes as a surprise to The Eye. It was only recently that administrators told supervisors that Officers would face discipline if they made remarks that were deemed inappropriate or put APD in disrepute. So does this mean that City administrators can now dictate who is allowed free speech and who is allowed what we could call "monitored, censored, and stifled speech"? Does the Constitution afford free speech to everyone, except law enforcement officers?

The administrators seem so afraid of officers voicing their own, independent opinion, that there are reports that social media websites are being monitored constantly in order to document the postings made by the officers. In risk of sounding repetitive, The Eye has still been unable to find the footnote of the Constitution that does not allow law enforcement officers to voice their opinion, ON their OWN time, not ON DUTY, even when not representing APD in any way. The threat of discipline (possibly including termination) via the means of intimidation, seems like the current "normal route" of business for the top administrators.

So, please enlighten The Eye. Which will it be? Is "everyone" protected by the First Amendment, or is it just a benefit for those lucky enough to be hand chosen to be protected?

It is the job of law officers to serve and uphold the law. Therefore, they are held to higher expectations and punished more severely when their actions conflict with their duties. Once again Eye; choose your stories more wisely.

Lets not forget family members of LEO's in all of this. Ya, that speech is being violated as well. In lieu of your spouse being terminated,, they just take the money right out of your pocket book. Nevermind if your spouse did nothing wrong! That doesn't apply here! What makes it even worse is that is is blatant and in your face. Un-friggen-believable!

That officer should be commended for stating, on record, that free speech trumps battery.

It's not that long ago that APD tear-gassed non-violent protesters who were exercising their right to free speech.

Anyone know anything about Peaches getting pulled over for DWI this past Thursday? Word is she got stopped around 10:30 am. Both APD and AFD were on the scene and she was bombed. Darren showed up in a city vehicle and drove her away.

How does Renetta Torres, the county HR director keep her job? She has just been caught trying to corrupt the process for hiring her new boss (the county manager) and yet she still keeps her job. She was there with all the Dantis and Lucero corruption, yet she is still there. When will the Bernalillo County commission demand her resignation? Until all the corrupt people are kicked out there will be no real change.

What about Peaches crashing her Porche into a curb on Mopntgonmery and not getting cited for intoxicated on drugs? Ron Bell got convicted, because he didn't have someone picking him up and getting him detoxed. Darren shows up and wisks the Peach off in his city car before the officer had a chance to write a report. AFD paramedics have the report though. Channel 4 supposed to be investigating
Why was she allowed to be release to Darren so he could take her home and flush her system?
Why wasn't she taken to the hospital?
When was the toxicology test done? The day after?
Who did the toxicology test?
Another cover up by the Berry _White administration. They just keep getting away with shit.

Any organization does not want employees to speak to media regarding their jobs, incidents, politics etc, whether it be apd or mcdonalds. If channel 4 stated gibbs as a citizen that's one thing but to label him an officer for apd that's a different story.

When you hire on to work for someone, you give up some of your rights. Take the military, they are not allowed to speak ill of their superiors in public.

Only a dullard would WRITE things down for folks to see that were negative (about their Job or superiors).

All over the nation, employees are learning that you cannot get on social media and disparage your employer. Free speech also means possibly being unemployed, Try telling your boss what you really think. This mentality is one of ENTITLEMENT. Seriously, What was the guy thinking who didn't understand what he wrote would find its way back to his bosses: he had to have had some idea.

While you file for unemployment- recall what your parents taught you.

I just don't understand where loyalty, honor and service went, for those lonely two or three guys who protect us. IN PRIVATE they will tell you how they feel, but NEVER in public.

A medical condition MY A$$ How can Chris Ramirez be saying she had a seizure, how can that be if she was operating a vehicle under the influence of meds "DUI" and crashed her car....Can you say Ron Bell??? Anybody else would have gone to jail. Peaches has been hooked on prescription meds for along time and anyone who knows her knows she rolls though the day on perks, and oxy and sleeps on ambien.....this is total crap and the paramedics from station 16 point blank called it she was totally whacked out....What any husband would do??? Any other husband would have been getting their wife out of jail.

While not salacious (those on the 5th floor or city hall can pause to look that up) or scandalous this is an important story. Of course the brass does not want you to believe so, because their interests lay separately from framers' of the Bill of Rights. Freedom of speech does trump other rights, including the rights of officers to speak their mind. Darren and Ray-ray may think differently, but it is because they will be gone by the time the city pays the lawsuits. Being sworn does not imply an officer surrenders those rights. Perhaps in the military, but that is far more restrictive. Darren and Ray are ignorant of this. They sit high on their thrones like two turds in a bucket; and are about as useful. I wish those who speak out have the courage, fortitude and financial resources (because it will cost them dearly to fight it and the brass know that) to fight for the rights many have died to defend. And thanks to Paul for continuing to speak his mind to the 5th floor.
As for the allegations of DWI, I'm puzzled as to what medical condition requires you to be taken home by a wanna be cop and politician. I think any doctor would recommend something ranging from an ambulance to eval at an ER or Urgent Care. Maybe the feds could get Darren for practicing medicine without a license if they are implying "the person in question" has a medical condition. OK that's a stretch, but the 5th floor pulls that crap all of the time!

The person "in question" has a medical condition? Then the mainstream media should report that! Every time I hear about a person causing an accident or wrecking their vehicle the media reports that the "person has a medical condition" or had a "medical incident" by way of explanation. Why does the media treat the city "moguls" with kid gloves? Don't ignore it in the hopes that it goes away!

Breaking: Public Safety Boss Took Wife From Accident Scene

Albuquerque Public Safety Director Darren White drove his wife, Kathleen White, away from the scene of a car accident on Wednesday morning after Kathleen White had crashed her vehicle into a curb on the 11200 block of Montgomery NE, Police Chief Ray Schultz said.

Albuquerque Fire Department medical personnel responded to the scene, which was dispatched as a motor vehicle accident with an “unconscious or fainting” driver, AFD Capt. Pete Logdon said.

APD officers also responded to the scene, Schultz said, but no DWI investigation was conducted.

The chief said he’s not sure yet whether officers should have investigated to see whether Kathleen White was impaired. That’s because the officer’s original report was “rejected for grammatical errors,” and Schultz is still waiting for a “revised” copy of the report.

Logdon said Kathleen White was transported to an area hospital.

He said he would “prefer not to” discuss whether Kathleen White displayed any signs of impairment. And he declined to provide a copy of AFD’s report, citing federal medical privacy laws.

If Darren's wife, Cathleen did have a feeling of "not being right," then it would have been better to have kept her under the care of Medics until she arrived at the Hospital. If Darren got away with taking his wife away from the scene, then Darren needs to get fired if Cathleen had been drinking and driving at the time she crashed into the curb!

The pro-life guy needs to live in Mexico for a month and watch how a Catholic pro-life Nation destroyed their own economy by having to many children to support. The pro-life guy needs to go to the Arizona border and set up a tent next to the Arizona river where 9 and 10 year olds are found drowned in the river becasue the Arizona government won't set up safety nets to help the illegal immigrants cross into the United States and know that it is giving those 8 and 9 year olds an instant death sentence! Barry supports Planned Parenthood in Mexico. I guess the Catholic Church ends at the border!

If Darren's wife does have an addiction to pain meds, then this won't be the first episode, only the beginning of a long battle till recovery from pain meds! Next time, it won't be possible for Darren to take his wife away from the crash site because authorities that leaked this story will be in a better position to get the help Darren and his new wife needs! Perhaps, she is addicted to pain meds because she is a homewrecker and is this the same female that Darren's first wife, Jennifer caught him cheating on her wife? Maybe the source of Cathleens alledged drug/alcohol abuse comes from being a homewrecker! If so, then that woman needs professional help! Looks like, Darren (a somewhat trained medic) isn't enough!

I just watched Darren White's live stream of the incident involving his wife and it was pathetic! Darren was excusing himself and he needs to be rerimanded for that! Why would Darren consider what he did to be "the right thing?" when clearly taking a wife away from an ambulance and ambulance equipment would be the exact opposite of "the right thing!" EMT are emergency medics that are trained to deal with a wide variety of incidents such as, a person overdosing and having a seizure from too much alcohol and/or drugs. EMT's are trained to spot that and usually the person is in need of fluids and suffers a seizure dehydration due to too much drugs comined? with drugs even pain meds! Maybe that is why Darren shared on the live video that Doctors felt that the wife of Darren might possibly suffer more seizures! Yeah! Sounds like another rehab wife! Gee, wouldn't admitting his wife needs rehab as the source of those seizures be a reason to celebrate instead of a medical condition that is not due to overdrinking and combing pain meds? Gosh! I hope Darren White doesn't come up with some horrible disease or illness to cover up for a mere drug/alcohol abuse problem!

Hospitals are more understanding and sympathetic towards people taking prescription medications than a police blood lab. For example, a Hospital takes into consideration the list of prescription meds and tests the blood and rules out "narcotics," based on what is expected to be found in the patient's blood. The police lab does just the opposite. For example, the Police lab doing blood work doesn't take into consideration what is normally to be expected in a person taking such and such medication. The policy in a Police lab is that "prescription medications," can be narcotics and are tested that way. For example, Ron Bell. Ron Bell didn't have the luxury of going to a Hospital to have a Hospital test his blood, but was forced to have a Police lab test blood. Had a Hospital test Ron Bell's blood, then the criteria would have taken into consideration what normally to expect with such and such proscribed medicaitons in the blood and Ron Bell's blood would have been found to be not having any narcotics in his blood. What is really important in taking prescribed medications is following the directions. For example, Cathleen might have had one glass of wine the night before, got into a jacuzzi, next morning had energy drinks with caffeine and didn't consume breakfast. Cathleen probably didn't have enough water in her system to combat the prescription meds. The difference in how Hospitals test blood and how Police lab test blood is a difference in Hospital Staff believing that people shouldn't be punished for taking prescribed meds and the policy of the Police that any prescribed meds interfereing with a person's ability to drive is a DWI.

I worked in a laboratory and can tell you the hospital performs blood tests for certain types of drugs and that's it. Usually the illegal type. Furthermore, it can't be used as evidence due to collection requirements and he probably know that. (I may be giving him to much credit). Darren obstructed justice by interfering with further investigation of her sobriety. If she truly were having seizures, he would have insisted the medical attendants take her to the hospital, because he would be ill equipped to handle an emergency while driving. 99.9 percent of the population would have jumped in the ambulance or followed it, but not risked their loved ones health and welfare by transporting them. He was definitely removing her from further scrutiny and should be FIRED!
