Perry Trips on His Own Jaw; Council in Quandary

In today’s Journal (read it here) “Albuquerque Chief Administrative Officer Rob Perry says he asked the city’s independent review officer to investigate a single-car crash involving the wife of then-Public Safety boss Darren White and its aftermath in his capacity as a citizen.” Perry claims that he made the request as a “citizen.” That is clearly a “White Lie,” in a letter from Perry to the IRO, Perry stated, “As we discussed on the telephone today, and at the request of Mayor Berry, I am asking you to conduct a thorough review of the facts surrounding (the crash.)...” Perry was referring to the crash involving Kathy White, the wife of former Public Safety Director, Darren.

Perry stated, “We believe this clearly provides the IRO statutory authority to investigate allegations of impropriety by all parties involved in this incident,” Perry wrote in the letter, dated Tuesday. “I dispatched a letter to Mr. Deaton asking him to do such. To this extent I am a citizen of Albuquerque, and the (letter to Deaton) can be construed as a complaint.”

Perry later stated to the City Councilors that the correspondence he sent to IRO William Deaton “can be construed as a complaint.” Perry opened his mouth and inserted his foot up to his knee. Construed; Perry was obviously double talking. Perry stated point blank that he was complaining and requesting an investigation on behalf of Mayor Berry. Perry sent (dispatched) an official letter on City of Albuquerque letter head and not on his own stationary. We can only be lead to believe that he drafted the letter on behalf of the Mayor during his normal scope and course of duties with the City of Albuquerque. Perry was acting on behalf of the City and not on his own behalf. Perry lied to the public and to the City Council.

The Eye already warned that the contract that Perry signed with the IRO may be illegal. The Councilors have recognized that there is a huge problem here and have asked for an independent investigation citing, violation of the city ordinance, “which states that the IRO is authorized to investigate citizen complaints against sworn police officers.”

Some profound words come from Councilor Ken Sanchez. “This clearly isn’t a citizen complaint,” Sanchez said. “I think the administration is digging itself deeper and deeper into a hole and not being transparent in what they’re doing.

Sanchez also stated, “The bottom line is the IRO doesn’t have the authority to do this investigation based on the contract and the ordinance. And this administration is finding a way to continue it, which is illegal and sets a very bad precedence that we are not following our own ordinances.” The Eye completely agrees with Sanchez which leads us to the next issue.

Perry's lying is terrible but what is worse is the conspiring that is going on behind closed doors. Schultz knows and should have told Perry, who is an attorney, that the City must conduct a criminal investigation first. This information is contained in the APD Standard Operating Manual. Under Garrity since it is a compelled statement, the statement(s) may not be used in a criminal investigation or proceedings. An administrative investigation will be maintained privately and no one will be able to see the facts. The big difference is, on a criminal investigation the results would eventually be made public.


The City Council is right on target and should stay the course. Schultz, Perry and the City are attempting to use legitimate means to keep the illegal doings private, hidden and concealed. The City Council must react strongly and demand a full and complete criminal investigation. Don’t be fooled by the simpleton games that Schultz and Perry are playing; they are trying to conceal crimes that were committed. This type of behavior is going to place us on the AP hotwire and ruin the rest of the City’s reputation. This is looking more and more like some of the things that transpired in New Orleans,Louisiana, that caused DOJ to come in and take over the PD.

The City Council has stated they will ask for an independent investigation from the City's Inspector General. The Mayor's spokesperson stated the administration will respect the Council's opinion. This is agreeable to the Mayor's Office because it will still be an administrative case which can be kept secret. The Council must demand a criminal investigation first; and then an administrative investigation may take place afterwards.

Instructions; do not lie and stop trying to hide the truth. Schultz and Perry should know that the truth always comes out in the end. Councilor Ken Sanchez stated, “I think the administration is digging itself deeper and deeper into a hole…” The Eye agrees complete with this statement and offers this advice; if you want to get out of the hole, quit DIGGING!

Berry, Perry, White and Schultz are seriously in a pickle on this one. This is not a class of intelligentsia.
These people are pretenders, imposters and should not hold office at all.
The DCs on the fifth floor aren't capable and we have a lot of under rated incompetents working at city hall.
All political appointees not qualified to run a fruit stand. Tito Madrid, TJ Wilham, Chris Ramirez,Sarah Lister,to name a few. The rhetoric of candidate Berry is much different than the Mayor Berry. Big talk, but when it comes to actually stepping in and doing the job, he's a miserable failure. First act as mayor he hires David 'Dick' Campbell and Darren White to run things as he is so insecure to actually take charge by himself. We are seeing the results of a man who should have never been. Never been elected mayor, that's for damn sure.

Since Darren and Campbell are gone Berry will have to roll up his sleeves and learn how to govern; be a mayor.
Perry is no help, as the first thing he does is botch up the Darren / peach thing.
Now we have the Murdock mess to clean up. About $2,000,000 will probably make that go away, but wait, that gets better as this administration won't have to pay for that lawsuit as they are not responsible for their actions. Let's just add that to the other $2M that Darren and Schultz have cost the taxpayers due to their incompetence and over zealous actions. The law suits just keep piling up. And lets not forget the multiple smaller law suits that are coming as a result of Darren's fleecing motorist/tourist on the freeway? Did I mention Tru-Touch............ on & on &on

Traveling to different parts of the country, you will see city and town governments with highly educated people running things and actually have a CODE. A code of ethics and behavior.
Albuquerque on the other hand, when under a microscope, reveals people in power as illiterate, uneducated, shiny pikers, pretending to have any code of ethics. It's a city government wrought with scavengers, demented and ethically challenged 'has beens', attempting to fool the people that they can run this city government, when in reality, given their level of competence and education, are only qualified to run a trailer park in Arkansas or Louisiana somewhere. Then again, who's to blame for this? The uneducated, ignorant populace that elected them, that's who. We deserve what we get.

I've been around the city for a while and can't recollet a time that was as dysfunctional as it is now. And I say this for all departments, as I have friends who are saying the same things about where they work -- the administrators in every department are all slightly stupid.

This might not have happened if Perry weren't trying to be the CAO and the City Attorney. Why haven't they hired a new City Attorney since Perry is the CAO? Why is he trying to be both?

7/27 @ 10:01 am: I'm not sure I'd go that far, however, the city is rife with employees that are beholden politically to each other, mostly to their higher ups, administrators, directors, etc. I started out as a temp. employee with the city over 15 yrs ago. I was told by a supervisor at that time, that if I wanted to be hired as a city employee, I'd better watch out who I aligned myself with and that I should make better decisions about who I chose as my friends. Thankfully, I transferred out of that department and took the requisite tests (back in the day) and got hired permanently. That is the problem with COA -- too many administrators promoting those they are close with, their friends, etc. In other words, nepotisim. I am an example of that. Because I'm active in my union, my department heads want nothing to do with me, as far as promotion goes.

I'm not big into unions, however, when push comes to shove and an employee is wrongfully treated or screwed over, the managers, bosses and department heads need to respect that and realize that this is the way it is and put down their

Is Darren White's mom or Dad named Jean-C Guenette? In Monday's journal she/he "blames White's departure on Socialist Unions". She/he stated unions are employee gangs formed to extort money, favors and special conditions from their employer. So when I hear you all brag about being a conservative Republican then why do you think the city should abide by the contract. In fact, why are you union? See how much the Republican powers that be really care about you. Sorry to burst your bubble, but you are so middleclass it's ridiculous. So while you chant for the Republican way I hope you enjoy watching the rich spend their tax break money on themselves, because they've hardly created jobs over the past 10 years they've had the breaks, while you lose your pensions, pay and benefits. Berry can't come out from under the desk. Perry hasn't figured out what Berry needs to say to the press. So for now, the best policy is to stay out of sight; TJ the $85K boot lick will fetch his lunch after he fetches Sal's. Darren's not around to tell him what to do and say, Schultz over in Germany fondling Fraulein and everyone's waiting for Deaton fake investigation to get completed.
Remember the South, where Klansman were caught red handed hanging folks of color, went to trial for it and were acquitted of all charges? Same thing here. These guys have the same ideologies and beliefs, They just don't where hoods. a real freakin 'Heat of the night' I tell ya.

What sort of problems has APD created with the district judges by bringing such a flawed and trumped up case against judge Murdoch. It seems APD has very little credibility with the public and I would guess APD is well on its way to poisoning its relationship with the courts. I'll tell you if I were on a jury I would be extremely skeptical of anything presented by APD and its representatives. Actually I was on a criminal jury last year and the case was dismissed because the cop made up some absurd BS about his probable cause. He cited a law that did not exist and the judge called him on it.

Don't put ALL of apd in the light man...it is the high ranking officials that ARE doing this investigation. The majority of the men and women behind the badge are good people. Until you know every single one of them, don't make the assumption that they are all like Ray Shutlz and Darren the dipshit White.
