New Answers on the Taser Investigation into Ray Schultz, and the Deal He Greased. Pay to play that is prosecuted everywhere else is being covered up in New Mexico.

Our Eyes have just told us the plan going on over at the New Mexico Attorney General’s office, and it about perfectly jives with the information we have been hearing.

This is an election year, but on top of that, we all know the “will” those in charge with holding public officials accountable for their misdeeds have for going after targets like Schultz, and the dozens of others who so far, have NOT been held accountable for their actions that precipitated the crumbling of our city and police department.

What we are about to tell you should make a second term for Hector Balderas not happen under any circumstances, if this is all true. Nobody should be allowed to dodge a given duty out of political concern! NOBODY!

Our sources are telling us that the Taser / Schultz investigation is being purposefully left to die on the vine, and wither away by the AG’s office, with efforts in place to make sure nobody is able to ask questions or find out what is going on, until it just doesn’t matter anymore.

We all know that when the now mayor Keller did his investigation as the state IG into the Taser deal, after emails were found with Schultz clearly stating the deal had been “greased” between Taser and the city, there were crimes committed, and the case was forwarded to the Attorney General for possible prosecution.

We all know that Louis Robles was Schultz’s go to guy for legal representation in the Taser investigation. We all know that Robles, his associate Brian Colon, and Hector Balderas are all buddies, like peas in a pod.

Now here is how they are doing it.

You can not get information on an active investigation through Inspection of Public Records. The AG knows this, and the case is being kept open. It is inactive, and nobody is assigned to it, or working on it. That is right. NOBODY IS WORKING ON IT! Why you say? Because statutes will run, and it will just die, and wither. They do not want to touch this, because it involves everyone, and it is politics as usual. This blatantly means that the political careers and futures of politicians are more important than holding corrupt officials accountable for the sad state of affairs our whole state is in, because of a few criminal dirt bags. No matter how small the charges may be, or who it may affect, or drag back here, there is no excuse for this. It is reprehensible and heinous on the part of an office in charge of holding everyone accountable. They are hoping this goes away, so as not to disturb political careers. When things like this happen, it is usually because the trail will lead to political cronies, supporters, and friends. This is unacceptable. Essentially the investigation is being kept floating as open so they can ignore questions about it.

We are being told from within that as long as the case is kept open, requests for information can be withheld by claiming there is an ongoing investigation. This is playing the system for one’s own political benefit, and it is malfeasant.

Knowing all of this, this political hot potato can be kept in limbo for as long as they need it to be, essentially allowing certain people to avoid making the hard decisions, and choices for the welfare of our community, as they were elected to do, because of their own political reasons.

Right now, the AG needs to be called on the carpet for answers into this matter, just like is being done with Geier and Keller. He needs to reveal who is assigned to work on this case, and what the progress
 is. There was supposed to be a grand jury convened, and we were told that that was cancelled too.

So we are going on another year after the AG said the Taser probe has widened, and they were coming to a close. What has changed? Political Tetris positions have changed, and elections didn’t pan out the way people thought they would. Aspirations have shifted and certain issues need to be hushed up. Brian Colon is running for Inspector General now. The horse shit is getting old, and everyone knows these three are connected at the hip, along with their previous relationships with Ray Schultz.

We here at the Eye believe the system in the State of New Mexico is more than broken. We believe it is being systematically and intentionally sabotaged, and enough is enough.

Every citizen in the state needs to stand up, and call these liars out on their inaction, because they have been making fools out of everyone while profiting from it. Corruption is a cancer that is spreading outward.

This is an excellent and genuine comment, and we appreciate that. It is free of agenda, and lays it out pretty well. It brings up points that people want to discuss, considering the history of malfeasant politics in our city, and it shows the frustration at hand. This is what we like here. We appreciate the bluntness. It is way better than the slimy, agenda driven, passive aggressive shit attacks we get here, from those that disagree because their ego, political plans, or cushy assignment prospects were dashed to pieces on the shores of life’s many disappointments.

Nobody here is on anyone’s nuts. Rest assured of that. This was all about denial of access, and cover to those responsible for the state of affairs of our police department, and city. It was about taking away that access, and exposing corruption. As much as things may appear one way or another, considering the perception and vantage point. One thing is for sure... the dynamics will be changing, because promises were made to clean this up, and make things right. This is our objective too. The Eye is organic and operates as so. It is beholden to nobody.

The problem in our city is people who think they are more important and worth more than you, us, and everyone else around them. These absolute vermin have destroyed the city with this mentality and their criminal actions. Those who stood by, and watched are guilty, and those who “got theirs, and took off to avoid the heat, and accountability when the DOJ arrived are just as guilty too.

The secondary problem, are the pests who want to hear themselves talk with their bloviated calling of the shots, and predictions as they say. They have predicted nothing, and they too are cowards, as they run their mouths from well insulated positions, or already have locked down high dollar pensions. You are also going to see the false cheerleaders, and blow jobs coming out of the woodwork too. We will be doing our best to preempt all of this or call it out for what it is, and outline the motive.

Going back to Berry’s election, we know for a fact that during his campaign he told many that if elected, he would toss Ray Schultz in the shitter. That is a fact, but something happened. That “something” is always the gutless, parasitic cretins who think they are power brokers, sitting behind the scenes cutting deals, or calling in favors for political support, or other issues that may be needed down the line to get what they want, or support their agenda. These are the people we are observing now. In New Mexico, this picture is large, but when it involves criminal activity it is racketeering. It is the reason why Brachle was not indicted for shooting a fellow officer. It is the reason why the Albuquerque Journal supported Dan Lewis and Brian Colon at the same time. It is the reason why they then changed their tune, and supported Tim Keller, when the other two were called out on certain issues, and it was evident Keller was going to take it. It is the reason why Ray Schultz has not been indicted. It is the reason why Nate Korn of Kaufman’s West Army Navy gave campaign donations to a candidate Lewis, when his wife is a political appointee of Republican Governor Martinez, and he himself supported Martinez and Berry, while being Ray Schultz’s main cheerleader, and dirt doer at the New Mexico Law Enforcement Academy Board while he was there. It is the reason why Darren White, who is a shameless Susana Martinez water carrier gave a large sum of money to a Lewis in the mayoral election. It is the reason why there was a campaign of disparity in treatment of officers during the Scheme Schultz himself devised to keep the DOJ out of our city while painting people stains on the badge when these people are the biggest shit stains on humanity. It is the reason why criminal officers were covered for, and allowed to retire, while others had cases fabricated on them out of retaliation, animosity or to defraud the DOJ, for doing their jobs, or trying to raise a child. Albuquerque has been one big fucking racket for way too long, and sometimes fucking up co-conspirators best laid plans is the path to reconstruction. The police department suffered from all of it, and now you and your family are suffering from the fallout of officers who shut down, to avoid being victimized by a malfeasant, malevolent, self serving administration, out to cover up their corruption on the backs of any target of opportunity; hence our out of control crime rate, that correlated directly to illegal and unethical actions taken out on the police department out of desperation by former Police Employee Ray Schultz. (We will not call that bag of puss a Chief any longer.)

The people that you do not know about, who lurk about like cowards, torpedoing lives, and destroying the very thread of everyday life in our city, for their own advancement, do so out of greed, power, and sex. This is the problem. One of them knew all too well how serious this was when he got on an airplane, and left the city the day after his criminal administration was toppled, and he had no more cover. That fat red faced drunken bitch is now in Indiana. Indiana! How funny is that? How the fuck do you end up in Indiana from Albuquerque? You pack your bags and run like the bitch that you are in the middle of the night to follow your wife who is the only one left employable in the family. That is how.

You will hear the same people bring up the Eye and Berry from Berry’s first election win. They were the same people that contributed thousands to him, BUT they were the same hypocritical spineless cowards who remained silent for eight years as we tore this administration a new ass weekly, with every bit of intel we could muster, without giving up our sources. They were the same people who “got theirs” then got the fuck out, and left the mess for everyone beneath them. How many people would still be here if certain bits of information had not been released. Three evolutions of upper command staff turnover happened under Berry.

Everything is here in the archives. We were lied to, and we dealt with it with viciousness, and ferocity that you do not see in many other cities coming from a blog. This blog was started under the Marty regime. We all know what went down during those days. Berry knew it, and although you may think he got away with something, that pathetic clown will probably run away too. Just compare his photos from eight years ago to one taken today. He looks like a bag of ass, and all of his hair fell out. Bad things people do have a way of catching up with them. The stress, and lack of a reputation will take a toll on that boy forever. We do not envy him.

So, knowing that the stakes are very high here, there is not much room to be dishonorable, or revoke campaign promises. With that said, we do know how hard things are going to be, and it’s only been a week.

Things are going to be difficult, because one of the groups we discussed above will come into play. There is major assburn over Garcia being kept on as deputy chief, and the bringing back of retired APD commander Harold Medina. As a side note... Medina couldn’t even raised his right hand for his swearing in ceremony properly. What cop, let alone someone who was promoted to the level of commander does not know that you place your left hand on the Bible, while raising your right hand to be sworn in? Harold Medina does not... That’s who! How embarrassing is that?

The look on Keller’s face as Medina raises the wrong hand and ignores the Bible is priceless?

Things are also going to be hard, because there is not many. The pool of good leadership material is thin. You will see where the rubber meets the road, and who is in it to win it in time, because word is that a few are angry they weren’t promoted. We will see who sticks around to fix things, and who takes their ball and goes home. Honestly, we don’t want to see spoiled self centered brats kept on. A handful of dedicated loyal individuals can do the jobs of dozens if they know they are backed, and there is mutual trust between the officers, the citizens, and the command staff. As we see it, it is the command staff’s obligation and responsibility to regain the trust of both the officers and citizens. If you want to call yourself a police executive, you better understand what comes with that. Schultz, Eden, Huntsman, and the rest of the previous filth had no concept of that.
Although there are things we disagree with going on, we will deal with it, but we will not throw grenades at it, without a baseline to go on, because there are good officers depending on things to change drastically for them in a good way. If that does not happen... If officers get shit on we will address it. The same goes for all city employees and our citizens.

The fact of the matter is that Keller’s apologizing for complete assholes, who shot people with ashtrays, lotion bottles, cell phones, spoons, or who were just plain unarmed, for crimes ranging from nothing, to petty misdemeanors is called owning it. The fact that people were shot when they did not have to be, or as they were being talked down, and about to comply, like Boyd and Ellis and having to listen to jackasses on police audio recordings exclaim “ oh fuck fuck was that me?” when their gun goes off, then observe a whole entire city attorney’s office, and police department justify a negligent discharge of a firearm after a fathers kid is killed... THAT is the problem here. You can not deny that there were several unjustified shootings in our city that denies belief. How do you justify shooting someone standing on their own front porch from across the street, in the back, when they have a spoon in their hand, and the officer knows it is a spoon, then promoting them. How do you justify skipping over officers for promotion, just because you do not like them, when they have stellar records or better yet railroading them off the job to distract from upper command staff public corruption? How does a shoot get justified where an officer knows an object in the hand was a spoon, but the excuse was that the officer felt he may go inside, and get a gun? It does not work that way. That is not an imminent threat, but this was one of many unarmed shootings this officer had, and another one of the many ridiculous excuses that people are sick and tired of hearing. How does a mental patient get killed in his own back yard by the police when he is unarmed just because an officer bit off more that he could chew physically, and precipitated the situation? How does an officer shoot an unarmed suspect in the back, stand over him and shoot him again and lie about there being a gun in his hand and not get indicted for murder? There are use of force cases that need apologizing for, and actual prosecution of, and there are use of force cases that look like absolute shit, but are justified. People understand this, but the previous administration under Ray Schultz had blurred the line so badly that nobody, even the officers trust anyone, and that is no good. It is the reason why we are here. Some apologizing needs to be done on both sides, and the administration carries most of the weight on that. The competent officers know they didn’t fuck up. They know who the fuck ups are, and they don’t want to be around them either. If officers are cringing at some of these things, something is wrong.

You will never hear a good cop complain about the field, fighting criminals, dealing with drunks, ignorance, or anything related to police work out there in the trenches. The constant enemy of the good street cop is the self important, micro managing attention whore of a police executive who uses them for a stepping stool. That is going to stop. The failed leadership that betrays the rank and file out there every day, doing what they themselves can’t do, don’t want to do, or are too good to do will always be held accountable by us, because that is what destroyed our city.

The citizens have been duped by New Mexico politicians for decades. This has been done on the backs of employees, officers, other politicians, and the citizens themselves. As the song goes, you can’t always get what you want, and this is true here. Now THEY can’t always get what they want, because even though there are still unavoidable tentacles of influence throughout the place, there are also more Eyes. After all of this, and everything that happened, betraying the good for selfishness will never be lived down, if it is the result of intentional malfeasance. There will be stumbling and growing pains, but mark these words, there will be accountability. That is pretty much the climate we are in, and everyone knows this because of what happened, so mimicking a Berry regime is not likely.

Another reason we went this route was because the Mayor had a background in accountability based government. He conducted audits and knows what Berry and Schultz did and what they are. He was also none of the above when it came to the politically connected who are responsible for what happened here through their direct actions, or affiliations. We also decided this because he had a background in government an had the best plans for action.

You know what we do. We do not betray, nor do we stab backs. We react to deception. We only ask that the right thing is done. We ask that the wrongs be righted. Nobody is a peasant. Every wrong needs to be addressed. We ask that an honest attempt be made at all of this. This is all that can be expected. We are a week into this now. Let’s see what happens. All does not happen in a week. This will be a process. We will be watching, and so will our Eyes.

Feelings will get hurt. We can almost promise that, because we know who the posers are, plus you can’t appease everyone. We know who sat back, while the injustices were taking place. We know who reserved endorsement, until weeks before the runoff. We know those same frauds are standing in the crowd behind the Mayor, like they have been there all along, and we have their names, and facts to back it up. Those people are the ones who’s feet will be held to the fire when they decide to take the political, or low road approach to doing the right thing. We are also tired of union officials walking around like they are a boss, or bragging that they have the mayor’s ear. You know who you are. Get out your insulated booties mister “bro” because your shit is no longer going to be tolerated either. Joey boy learned it the hard way and you can too. If we smell any selfish agenda we will put it out there.

All in all, what we are saying is give it some time, but keep a close eye on everything. It is all we can do right now as things start to settle in, and get rolling. Taking care of Lou Golson, making the commanders give up the incentive pay, and filing an LEA90 against former Lt. Brachle’s certification were outstanding first moves. We will continue to keep eyes on the appointments, along with circumstances as they unfold. We want to see things made good, and safe for all of our citizens, officers and firemen.

We do not know how we will feel tomorrow, let alone 4 years but we will see, and so will those who choose the wrong choices.

No one person is Albuquerque’s savior. It is up to all of us.

Epitome of the worst of Hypocrisy. Illegal campaign contributions in the Lewis campaign, when he wants to cry about the ethics of others point to those behind him are Schultz cronies. 2 complaints with multiple violations filed on Dan Lewis that the media is failing to tell you all about.

Dan Lewis decided to board the Santolina band wagon, in reference to the lies being spread on Tim Keller, and now it is backfiring on him, and shining the light on others.

We have seen this administration destroy this city, with the help of an in place infrastructure.

When Berry was elected, he decided to keep Ray Schultz in place, when he should have fired him, because he obviously saw Ray’s manipulative connections within the media, his underhanded methodology, and his corrupt ways as a plus for his agenda. Those ways still thrive.

Others saw Ray as a boost to their bottom line too.

It seems that there was a second complaint filed on Dan Lewis for ethics violations involving his company Desert Fuels, and their company’s owner contributing to his campaign, when they are city vendors. They want to play games with the categorization, but his company has a contract with the city, and that is a fact.

Above is a supplemental to that complaint, with a growing list of contributors who also have conflicts, because they are city vendors. This is an issue, because Lewis is not only a mayoral candidate, but a current city councilor.

Dan wanted to point fingers. You know what they say about pointing fingers Dan? We do. When you point a finger... four more fingers point right back at you.

Here’s to pointing fingers Dan.

They have showed that those who support Dan are looking for the same of what the previous administration gave them; favoritism to the point that they would break the rules to get what they want... especially that little cretin, number 7, who is the BFF of Ray Schultz, owner of Kaufman’s West Army Navy, and who has been hooked up over the years with lucrative contracts by Ray, as both he and Ray ran amok on the New Mexico Law Enforcement Academy Board, violating the civil rights of employees for political favors, or just plain because they could. Standby though, because that shit is about to catch up to these fellas, as there is a looming investigation pending into something that is going to open cases for every year these cowards have been pulling strings up there, with the help of individuals involved in government positions.

Pretty soon, calling in political favors, judicial misconduct, fraud on the courts, witness tampering, perjury, official corruption, permission of perjury, and getting away with it will be a thing of the past, because a bigger Eye than us will be on it.

Everyone had a chance to make decisions to do the right thing. Everyone is sick and tired of them choosing to do their thing. Now the decision will be made for them... first by the voters, then, by the judicial system.

Do not let Berry and Schultz cronies continue to have influence through their cultivated plants anymore. Rip their influence away from them. Lack of access means the loss of control of the variables these filth need in place to protect them.

It is evident that the Albuquerque Journal, along with many others who supported Berry and Schultz are now seeing cover, because they realize what is coming with the changing of the guard.

Vote Keller on November 14th.

BACKFIRING CRITICISM AND THE SAME FROM THOSE RESPONSIBLE FOR THIS MESS

The last couple weeks of the election trail here in Albuquerque has been an example of what has been going on for years, and what put this place in the situation it is in. We all know how politics can get, but New Mexico politics is probably one of the more slimy nationally. Those here would rather see failure, than to put their ego aside for the common good, and they will do anything they need to get what they want.

Last week we saw Albuquerque reporter Chris Huffman Montalban Smith Jones Chan Nikolai Ramirez do a surprise article on Keller donations over in kind donations that there is no ruling on, and which are documented. It is interesting to note how McCleskey was on the grand jury investigative hook for a long time, but no surprise visit interview was done there. A point to remember was that this reporter used to work for Berry. Those donations are legal, and unlike the criminal actions of this administration, and their political supporters, millions were not lost in lawsuits, nobody was defrauded, nobody lied about it, the record of all of it is there, no employees or citizens were railroaded to cover it up, and nobody lied when the issue came up. It is all documented. Good luck getting documents from this administration, or the millions lost to their malfeasance.

There were also many people going around citing the KOB and KRQE polls as the first numbers out on public opinion on candidates. That isn't the case either. There was also a poll in the Albuquerque Business Journal weekly. Keller won that poll, but it seems some very odd things are going on with these polls, as they are shut down early.

ABQ BIZ JOURNAL SURVEY

Recently, the KRQE poll conducted last night after the Mayoral Debate was shut down before the twenty four hour mark even hit. If you read the comments, you can see some accusations, and we have received a few complaints here. Lets hope this is not the case. There will be no change electing someone who is just a Berry 2.0, or someone who is tied to Schultz by their balls. That is a fact.

KRQE MAYORAL DEBATE POLL

We here at the Eye feel that there are some very sincere people in this election. We also feel there are some wolves in hamster clothing who are in it for financial gain, political drag, to hook up their cronies, and to fill their pockets, while feathering their nest for the future on the backs of our citizens and employees. You will see things play out very soon in reference to all of those who are in it for the wrong reasons, because the unjust can not help themselves. Keep your eyes peeled for the usual antics of finger pointing, and attacks from those with their own back yards full of garbage. Look for the crying and playing of victim too, because they are all traits of the current administration’s culture.

What is worse? Representing filth, and standing like a man, saying yes I did that, or representing someone, and denying that person to distance yourself from them, because it does not look favorable for your campaign? It really does not matter, because we bet the representation of Ray Schultz was never officially ended, meaning that if Ray needs an attorney, Colon’s firm would represent him. Not only that, but Ray Schultz’s long time BFF Nate Korn, who owns Kauffman’s West Army Navy donated $800 to Brian Colon’s campaign. No surprise there! It is funny how these self preserving / serving individuals will flip flop any which way they have to in order to benefit their agenda. We all know how imbalanced, unfair, and outright crooked the NEW MEXICO LAW ENFORCEMENT ACADEMY BOARD WAS under Korn. We all knew that there was an unexplainable amount of disparate punitive measures laid out on anyone who Schultz deemed a target to be revoked, or retaliated against, and the proof is there to stand it up. One assistant AG had resigned over tampering with cases, along with other hearing officers over the conduct going on up there. We all know that Nate Korn buys in when it benefits Nate Korn and this sends a clearer message that Colon is allied with those connected with Schultz.

One last thing. Today through social media, we found out that Dan Lewis’s own Turf is supporting Tim Keller in the election. Yesterday it was announced that ABQWest Chamber of Commerce is endorsing Tim Keller. You can read it above. Now that folks is a kick in the balls.

Most every union and association in the state seems to be behind Tim Keller. We will wait, and see what the APOA does in the near future, considering who they will be supporting. From our Eyes in the field, we know that most of the officers with APD are supporting Tim Keller. Our Eyes are telling us there is much wavering over possible money issues, and personal promises made, but Keller laid it out as opposed to the others. Things will be negotiated, and he will support our officers so that they can do their job under a just, and not corrupted administration. No lies like Berry told, but admitting there will be raises.

As for the rumored attacks coming down the pipeline… we will be watching closely, and observing for the usual suspects, along with their motives, and where these snipes are originating from, because you are going to see the same creeps who stood by while this administration burned down the barn, twist words, manipulate circumstances, and flat out lie to make it look like someone ate a chicken egg that wasn't theirs. Remember the difference between what something looks like, and what it is, because all of these attack traits can be seen in this administration.

We are looking forward to a new administration, and an end to this back biting, candy ass, horse shit, and it will be nice when we have positive things to say for a change.

Raymond D. Schultz is having a good time fooling the folks in the community of Memorial Villages Texas into thinking he is a great guy, after he destroyed this place with the help of his coward friends. As we have seen with many ranking members here, the rules change when you are under criminal or grand jury investigation, because they do not get put on leave or terminated. As a matter of fact, people like Ray Schultz's friend JD Sanders can actually get hired as a police chief in another state, while there is action pending regarding his certification after resigning over an internal affairs investigation into misconduct, concerning him with the Hobbs NM PD. This is no coincidence, because Ray's BFF Nate Korn was the vice chair of the board at the time, and Director Jack Jones was present, and advocating for JD Sanders who was not present. We would like to ask our LE readers just how would your absence at your own LE board hearing be handled? Would the director have advocated for you as be did for Sanders? Would they just get to say that there were lots of allegations, but nothing happened? No, not even close, unless you are connected to these cowards. Many media outlets have ignored the little details above, but we here will not. A chief resigns from his position, an LEA90 is filed, and nobody asks questions when he rendezvous with another chief, who fled his last place of employment TOO. Seems all of these people are skedaddling, now that things are coming to light. But they aren't worried about the Corvino case, are they?

This should enrage anyone who has had to deal with the disparity in case handling up there in Santa Fe, especially those who have had action taken against their certifications, after signing agreements with municipalities agreeing to no action in lieu of resignation.

There has been a lot of talk about departments directing their staff to Kaufman's West LLC for their equipment. Why? Why direct people to a place where their prices are high? Why direct anyone to a business owned by an individual who condones corruption, by openly praising former employee Raymond D. Schultz as some kind of "E.F. Hutton," when all he is is a coward who used people, destroyed the place, then moved on when the heat came down on him; a snowflake. Enough of acting like something did not happen. Ray Schultz is a liar, who has perjured himself in numerous cases, while under oath, and he was allowed to do this by people in oversight positions, who dare to take the high ground, and act as if they were cleaning the place up, when THEY were, and are the problem. They did this. As the rats jump ship, the rat feeders should be sent packing with them. WE HERE AT THE EYE ARE CALLING FOR AN EMBARGO OF ALL BUSINESS WITH KAUFMAN'S WEST LLC. There are better places to do business with better prices. Try the below listed vendors. They are nice people that get shut out by a corrupt administration. Do not give money to a business that has profited from the likes of Ray Schultz, and is owned by a person who has obviously pushed cases in the favor of violating employee rights, politically bullied decisions in the desired direction of his buddy's choosing, and disallowed the simple right to free speech at public hearings. You do not get to destroy places and lives and walk away. Hillary Schultz should not get a free pass. Indict him.

Entanglements cont.

Some very interesting posts came in over the last day and deserve to be highlighted.  First, the term "Tasergate" has been picked up in the media. Credit for that little doosey goes to our frequent, and sometimes hated, poster known as the "Tremendous Regulator." So before KOAT's Doug Hernandez tries to claim it as his idea....well it wasn't.

Also, we've been flooded with emails regarding other parties who seem to have their priorities entangled with Berry's objectives to keep the truth hidden and reality obscured.

One such party is Robert Caswell and his company Robert Caswell Investigations. You see this is a private investigation firm that the city has contracted with for years. Yet we were forwarded the following, Eye-raising information. It seems, 2013 was a very VERY good year for RCI:

Why would there be a 371% increase in fees paid? And during an election year? Hmmmm....

Then of course there is the matter of Kaufman's West owner, Nate Korn. You see aside from being a huge supplier of equipment to APD, Mr. Korn is also the vice-chairman of the NM Law Enforcement Academy Board. Mr. Korn is frequently the acting chair of the board. So while today's paper was quick to assign blame on AG Gary King and his involvement with the fiasco at the state's police academy, let's be real, Mr. Korn has been the one pushing for the reduction in curriculum and what can only be described as sheer fandom of state academy director Jack Jones.

Hey Kent, we have Eyes on your game; if it's good for the goose, its good for the gander.... We don't see Gary King having any financial relationship with APD unlike Korn. In fact we applaud AG King for his scrutiny of APD last summer which truly was one of the first, most objective, and honest of analysis of one of APD's most repugnant incidents. Conflict of Interest Confirmed

As many people know, Nate Korn is the "citizen at large" member of the state's Law Enforcement Academy Board. It is this board that decides to institute a wide range of things including whether to take a police officer/deputy's certification to the recent reduction in required training in order to get that certification.

This past September the board held its monthly meeting at APD's police academy just behind the Valley Substation at 2nd/Montano NW. Our Eyes recently forwarded us the following remarks that were made at what was Ray Schultz's last meeting as he was the board member representing city police departments in the state:

MR. KORN: "I would like to add my comments. It's true, as Mr. Barncastle has said, that Chief Schultz has been a mentor and a friend to all of us on the Board. I'd like to share with the people that are assembled a quick story about the way our Board would operate when we get in closed session. We talk about cases. We are almost always unanimous in our cases. Some cases are a little simpler than others for us to come to a quick conclusion. Other cases we have to sit over and battle through the facts and really think it through. And on those times when we're trying to battle and figure out how the case resolution should be fairest, frequently what would happen is all of us would give our comments. And Chief Schultz would be the last to talk. And then, when he would finally speak, it would be like EF Hutton. Everybody was quiet and we listened to what he said on these difficult cases fell into two grounds. One was he would find something that was so obvious that we missed that made all the difference in the world. And then it was like a light bulb coming on and we're all going on how come we didn't think of that. It was just very brilliant and it was there all along. And the other one would be where his years of institutional knowledge, either on this Board or at APD, came to bear. And he would take complex cases and help us understand how to best simplify them for the law and the facts. So that was something that I think all of us benefited from. And I know I certainly learned so much from the chief. And his presence will be missed. We wish him the best of luck in the future."

Aside from what is obviously and clearly patronizing praise, did Mr. Korn bother to reveal his vested business interests with Mr. Schultz's department? As we all know, Kaufman's West holds many city contracts with the police department. Including most recently the replacement of all of the soft armor vests issued to APD personnel....  And in the context of DOJ coming to town and pouring through APD's records, is this statement by Mr. Korn not simply, well, bizarre?

Concerned Citizen Calls Into Question; Questionable LEA Results

Isn't it amazing how the same names are tied to so many stories about corruption or possible corruption?  The open letter from a concerned citizen outlines test results from the New Mexico's DPS LEA.  Is it possible to have all these geniuses receiving certifications from LEA?  The panel that did an inquire from three different agencies. 

The highest ranking was from the APD staff who would have been a party to any offense.  The APD Lieutenant was Anthony Montano who is part of APD Academy's staff.  It should also be noted when Channel 4 asked to interview Lieutenant Montano, he cowardly refused and referred them to NM DPS.  Does anyone see an impropriety or at a minimum the appearance of impropriety? But for Mr. Arrogance, Ray Schultz, this is how business is done; "since no one knows what a chief does except him."

New Mexico's Public Safety Secretary, Gordon Eden, crossed his arms and stated he stands behind the test result 100%.  The Director of the New Mexico Law Enforcement Academy, Louie Medina, agreed to be interview and when Channel 4 arrived to do the interview, Medina stated, "the interview had been cancelled based on the advise of their legal counsel."  In our experience, when someone "lawyers up" it is because they have lied or did something wrong.  Is that the case here?  Read on and you can decide if there is a problem here or not...

Is it me or do you think the majority of New Mexicans don't trust their police?

My concern is the Gadi Schwartz story about possible cheating at the NM Law Enforcement Academy. (READ IT HERE)

 

These are officers/deputies hired by smaller agencies throughout the state. It certainly seems that something strange happened at the final test, but everyone at DPS and NM LEA lawyered up. Why? There is no lawsuit and they are all public officials so how can they say their lawyers don't want them to speak? Again, are they not public servants? It appears something is being hidden, do you agree? Honest, open law enforcement seems to have vacated New Mexico.
 

If there was cheating on the final exam the citizens deserve to know. If there was no cheating the officers in this class deserve to be cleared.
 

It appears the 3 officers (APD, RRDPS and Bloomfield) who were supposed to investigate did nothing but talk to the staff and then rubber stamp what the powers in charge wanted. Where is the personal integrity to do a good honest job? It seems this hiding from the public, information they need to know, is at every level of law enforcement in New Mexico.
 

The public deserves better. It frustrates the public that the people in charge are not being open and responsible to the public they serve. This clearly is trickling down to the lowest levels, just look at the number of APD officers being charged with crimes. Many were only charged after public outcry (Levi Chavez). Where are the leaders? Why are they hiding information from the public?
 

APD has played this game for several years and now look at where it has gotten us, DOJ investigation. The Columbus PD is under federal indictment for gun running, Alamogordo PD refuses to honor public records requests, several APD officers are under indictment, APD leadership is named in so many lawsuits we can't keep up.
 

Yet when the media asks questions they have to fight the powers in charge for what should be public records. It appears to me that from the top to the bottom New Mexico is in crisis with ethics in law enforcement. Our law enforcement leaders seem more interested in hiding the truth from the public, than in doing their jobs and instilling ethics in what was once a proud profession.

 

I would like to think the 7 members of the NM Law Enforcement Board would demand an second, thorough investigation of the cheating allegations.

I don't think this Board's priority is providing the public honest answers or they would have already demanded a second investigation. Oh but I forget myself, Ray Schultz says if you are not a Chief you just don't know. God help us all.

WHAT EVER HAPPENED TO "INNOCENT; UNTIL PROVEN GUILTY?"

"MR. KORN: I'd like to first thank Chief Schultz for taking the time to think about how the board can be better and how it can better serve the citizens and also the officers that aren't under a cloud of suspicion or indictment or arrest."

So said Mr. Nate Korn (Aka Nathan Kornfield) during the August 28th, 2012, meeting of the New Mexico Law Enforcement Academy monthly board meeting. Mr. Korn's comments came in response where APD's Chief Schultz just presented a policy change that decimates the rights of law enforcement officer's statewide and relieves employing department's of virtually any obligation of due process to their employees. This past Tuesday, October 23rd, the LEA board accepted and adopted this policy change by a unanimous vote thereby making the policy effective.

For those that don't know, the policy change that Chief Schulz proposed and Mr. Korn proselytized, concerns the revocation of a New Mexico law enforcement officer's certification to be a law enforcement officer. Think of the certification as one's license to drive, or to practice medicine, or to practice law. In order to be employed as a police officer/deputy in this state (and almost any state) you needed to have the necessary certification to do so as under 10.29.1.1 NMAC et seq. Until this past Tuesday, in order to have an officer's certification revoked, they needed to have been found guilty of violating felony law, certain misdemeanor laws, or have been shown to have committed acts which display an absence of moral character, dishonesty or fraud. Now, thanks to adoption of this new policy, an officer's license is in jeopardy upon being charged with a crime or act of moral turpitude..NOT upon conviction or confirmation of such an event.

Chief Schultz expressed his reasons for this change in policy in no uncertain terms. "There was really no incentive for the officers or their attorneys to expedite the process and get it resolved." "...more importantly to move the burden to that officer to give them a reason to get the issue resolved as quickly as possible..."

But Chief Schultz displays his ignorance, or misunderstanding of the Constitution, when he stated, "It's not uncommon for your driver's license to be suspended prior to that due process."

For reasons unknown, law enforcement labor unions across the state failed to represent their membership by fighting this change in policy. Imagine if upon being issues a speeding ticket, or upon arrest, your driver's license was suspended. No court, no forum to challenge the charge, just immediate suspension of the privilege your license provides to you after having earned it. In other words, the interest in your license--a property interest--has just been taken by the state without any opportunity to challenge it until after it has been taken. Perhaps it is the stunning arrogance of this change in policy that has left police and sheriff unions in silence. Perhaps they simply don't understand what has occurred.

But there's an even more troubling concern to this matter. This new change in policy not only shifts the responsibility of proving guilt from the state upon the officer to prove innocence, but it also actually relieves employing agencies from any burden of investigation at all. Since this change in policy results in the immediate suspension of an officer's certification they will now simply be terminated by their department. You see, having a valid NM certification is a mandatory component of being employed with any accredited police/sheriff's department. Now that the troubled officer has had their certification yanked, the department has no reason to do any administrative investigation and can simply terminate the officer for cause. And what if the charges are show to be unfounded or dismissed? Too bad for the officer with this new policy, they now have to not only fight to get their job back but they have to fight for their certification.

And what if an officer is targeted by their chief or sheriff for wrongdoing that involves untruthfulness? The same policy applies, where that department head simply files the necessary paperwork to the LEA board, and poof! the employee's position is terminated upon suspension of their certification. If you think officer's are hamstringed to do their jobs in APD, thanks to Chief Schultz and Mr. Nate Korn, they now have impaired the ability of officers state wide.

But this change is not without irony...it now invites the scrutiny of the LEA board upon all law enforcement certification holders--including chief's of police. Is there anybody we know that is a holder of New Mexico law enforcement certification that has been shown:

(3) making false statements or giving any false information to the
academy in connection with an application for admission/certification;

(4) committing acts which indicate a lack of good moral character, or
which constitute dishonesty or fraud, and which adversely affects an officers ability to
exercise the duties of a certified law enforcement officer;

Something "Korny" Going On

The city of Albuquerque has many ordinances that mirror state laws but are refined to the particular, and allowable, form of municipal government that we all know as Albuquerque. To be sure the city is not a true sovereign entity; it owes its creation to state statute. Its capacity to exist and govern itself is contingent upon being faithful to its own laws and not deceiving the very citizens it hold jurisdiction over. As Justice Clark remarked, a government that fails to hold itself accountable and simply disregards its own laws voids its very existence.

At the forefront of Albuquerque's code of ordinances is the "Conflict of Interest" ordinance §3-3-1. The main point being that "An employee shall disqualify himself or herself from participating in any official act directly affecting a business in which he or she has a financial interest." Since Albuquerque officials are entrusted with authority and money from the citizens they serve there is no greater breach of duty than to act in a manner where a city official puts their interest before the citizens...and from this ordinance there are endless other that effectuate a code of conduct that, if followed is beyond reproach:

Recently, our Eyes alerted us to a corporation known as “Friends of SWAT.” What caught our eye concerning this is not only does Friends of SWAT involve many current APD officers, but retired officers as well: APD Sgt. Jason Peck, Officer Armando Limon, Retired Commander Dan Cafferkey, Officer Ron Tosta, and citizen at large Nate Korn (or is that Nathan Kornfield?). Our Eyes wanted to know what a dominant city vendor would be doing as co-director within a corporation staffed with current and former city employees. We think it is hardly appropriate for a vendor known for selling police gear and equipment to the very employer of his co-directors!

Given Mr. Korn’s grandstanding about ethics and integrity while he sits on the state’s LEA board, we found this beyond disturbing. Through his business Kaufman’s West, Mr. Korn contracts with the city hundreds of thousands of dollars in police and police related equipment to APD each year. Given that each vendor is supposed to disclose any conflicts they may have when responding to the city’s RFP’s we wonder if competing vendors knew of Mr. Korn’s legal business relationship with these APD employees. What influence did they have in crafting RFP’s in a favorable way so that Mr. Korn edged out competition? What inducements has Mr. Korn given these or other APD employees? Can Mr. Korn and these officers honestly say their activity is consistent with these city ordinances and the many parallel state statutes?

In reviewing the details of the above city ordinances, it seems Mr. Korn and all of the directors are in clear violation of these laws. Sadly, it gets worse. According to the state Public Regulation Commission, Friends of SWAT has been operating out of the Valley Area Command since 2007 as its corporation and mailing address is 5408 2^nd Street NW (Link: HERE). How is this possible that a private business has been operating out of a secure government police facility? Who has been in charge of the Valley Area Command to allow this to go on? How much on duty time have these individuals spent in furtherance of their corporate interests while at work? What material benefit have they derived from the their relationship with an equipment vendor known widely for his “donations?”

While we thank our Eyes for forwarding this information, not only are we shocked and outraged, but we are dismayed. Given Mr. Korn’s personal relationship with APD’s Chief Schultz we think it is very unlikely Chief Schultz has no knowledge about this. On behalf of all the concerned citizens of Albuquerque and all of the hard working rank and file officers who operate by the very rules they enforce, we demand that the State Attorney General ans/or the State Auditor commence an immediate investigation and prosecution of all and any persons found in violation of the law.
