New Answers on the Taser Investigation into Ray Schultz, and the Deal He Greased. Pay to play that is prosecuted everywhere else is being covered up in New Mexico.
Our Eyes have just told us the plan going on over at the New Mexico Attorney General’s office, and it about perfectly jives with the information we have been hearing.
This is an election year, but on top of that, we all know the “will” those in charge with holding public officials accountable for their misdeeds have for going after targets like Schultz, and the dozens of others who so far, have NOT been held accountable for their actions that precipitated the crumbling of our city and police department.
What we are about to tell you should make a second term for Hector Balderas not happen under any circumstances, if this is all true. Nobody should be allowed to dodge a given duty out of political concern! NOBODY!
Our sources are telling us that the Taser / Schultz investigation is being purposefully left to die on the vine, and wither away by the AG’s office, with efforts in place to make sure nobody is able to ask questions or find out what is going on, until it just doesn’t matter anymore.
We all know that when the now mayor Keller did his investigation as the state IG into the Taser deal, after emails were found with Schultz clearly stating the deal had been “greased” between Taser and the city, there were crimes committed, and the case was forwarded to the Attorney General for possible prosecution.
We all know that Louis Robles was Schultz’s go to guy for legal representation in the Taser investigation. We all know that Robles, his associate Brian Colon, and Hector Balderas are all buddies, like peas in a pod.
Now here is how they are doing it.
You can not get information on an active investigation through Inspection of Public Records. The AG knows this, and the case is being kept open. It is inactive, and nobody is assigned to it, or working on it. That is right. NOBODY IS WORKING ON IT! Why you say? Because statutes will run, and it will just die, and wither. They do not want to touch this, because it involves everyone, and it is politics as usual. This blatantly means that the political careers and futures of politicians are more important than holding corrupt officials accountable for the sad state of affairs our whole state is in, because of a few criminal dirt bags. No matter how small the charges may be, or who it may affect, or drag back here, there is no excuse for this. It is reprehensible and heinous on the part of an office in charge of holding everyone accountable. They are hoping this goes away, so as not to disturb political careers. When things like this happen, it is usually because the trail will lead to political cronies, supporters, and friends. This is unacceptable. Essentially the investigation is being kept floating as open so they can ignore questions about it.
We are being told from within that as long as the case is kept open, requests for information can be withheld by claiming there is an ongoing investigation. This is playing the system for one’s own political benefit, and it is malfeasant.
Knowing all of this, this political hot potato can be kept in limbo for as long as they need it to be, essentially allowing certain people to avoid making the hard decisions, and choices for the welfare of our community, as they were elected to do, because of their own political reasons.
Right now, the AG needs to be called on the carpet for answers into this matter, just like is being done with Geier and Keller. He needs to reveal who is assigned to work on this case, and what the progress
is. There was supposed to be a grand jury convened, and we were told that that was cancelled too.
So we are going on another year after the AG said the Taser probe has widened, and they were coming to a close. What has changed? Political Tetris positions have changed, and elections didn’t pan out the way people thought they would. Aspirations have shifted and certain issues need to be hushed up. Brian Colon is running for Inspector General now. The horse shit is getting old, and everyone knows these three are connected at the hip, along with their previous relationships with Ray Schultz.
We here at the Eye believe the system in the State of New Mexico is more than broken. We believe it is being systematically and intentionally sabotaged, and enough is enough.
Every citizen in the state needs to stand up, and call these liars out on their inaction, because they have been making fools out of everyone while profiting from it. Corruption is a cancer that is spreading outward.
Shit collapsed, and officers can not do their jobs because scum betrayed everyone for their own personal gain. Where are these cowards? Not here! No! They fled like chicken shits. They are no longer dealing with the mess they created. Contact Hector Balderas and demand answers now!

IT REMAINS UNANSWERED
Today, The Honorable Judge David K. Thompson, division 4 District court judge did the right thing.
Today, the Albuquerque police department got more egg on its face, but more so, a murdered civil rights attorney, and her family came a little closer to justice.
We all remember November 18th, 2010, when Attorney Mary Han was found deceased in her home. We remember the top Albuquerque Police Department brass showing up to the crime scene, ordering officers to violate standard operating procedure, as former confirmed liar, DCOP Allen Banks told officers in charge of the scene to leave, as he and his gang of clowns turned the scene into a disgraceful circus. We remember people like TJ Wilham showing up, when they had no valid reason to be there. We remember the accounts of former police chief Raymond D. Schultz receiving phone calls from those on the scene but using his wife’s phone to return those calls, AND WE REMEMBER FORMER DISGRACEFUL ASSISTANT CITY ATTORNEY KATHRYN LEVY WORKING SO HARD TO OBSTRUCT, AND MUDDY THE TRUTH WITH HER MOB LAWYERING TACTICS. We remember all of it and we remember them all scattering like the cockroaches they are when the light was shined on them as their tactics to fend of the scrutiny of the DOJ failed.
Almost 8 years ago, and those who have caused all of this have left this city, and hundreds of lives in turmoil and wreckage, but today it was proven that when you take the home court advantage, and variable control out of the hands of corrupt public officials, there can be some progress, and the right thing can get done.

They claimed to tell the truth. They claim to conduct fair investigations. When challenged, after being caught obstructing the truth, tampering with witnesses and evidence, and directing numerous preconceived investigations to their desired outcomes, they claimed their proprietary knowledge made them experts in the field, and nobody should challenge what they say. They claimed over and over again that their verdict is the only verdict, because they say so, without ever really backing their conclusions with the truth, or untainted or complete evidence and testimony. Every single high profile case involving APD and the city Attorney’s office has been tainted for over a decade. It is all still coming to light now, and anyone who stands up to them is attacked, extorted and retaliated against.
Below, we are going to show you excerpts from the 96 page order Judge Thompson filed overturning the Office of the Medical Investigator’s determination of suicide regarding the death of Mary Han, to undetermined. The judge in this case ripped the OMI and APD a new one for failures on multiple levels.
For years, we have been providing evidence of how the command staff at high levels within APD have been bullying officers, and committing crimes as they tampered with cases for their own political agendas. Below yet more evidence of officers who did the right thing, but were threatened by then deputy Chief Allen Banks. You can see for yourself the culture and mindset of Banks. This has been corroborated by countless claims and complaints made by current and former employees of APD. Many cases are still plagued to this day with this type of mindset, yet nothing has ever been done to punished these scum bags for their criminal behavior. As a matter of fact, they have been rewarded with pensions and new jobs as police chiefs in cities like Round Rock Texas and Memorial Villages Texas. To this day we still do not have an answer to the open investigation into the Taser scandal involving both Allen Banks, and former disgraced Albuquerque Police Chief Raymond D. Schultz, aka Ray Schultz aka Turkeyneck.
We would like to commend the above officers, some of which had to leave the department out of fear of retaliation, for having the fortitude and guts to stand up to punks like Allen Banks, and this filthy administration, by telling the truth.
If you read this blog, you can see how many of these cases will be tied together forever, as Mrs. Han was working on lawsuits involving prostitution, that may have spilled over into human trafficking, involving many high profile police brass, judges, politicians, and the connected wealthy. Because of this, Taser, and countless other corruption issues, the question is how many more “it remains unanswered” issues are out there? How many cases were tampered with, just because they wanted to, or because they wanted to hide their actions?
Today, we know that Albuquerque NM may be one of the most corrupt cities in the country, with no accountability, and no oversight by outside authorities. For this reason, it is apparent that nothing will get better, until orders like this are followed up with criminal investigations, that result in convictions for corruption. People like Banks and Schultz still have pending investigations they are part of, yet nothing is done. Just imagine if an officer or citizen threatened, or intimidated a witness about their testimony. The book would be thrown at them, and their whole life would be OBLITERATED. In New Mexico the district attorney’s sit on corruption cases like Raul Torres is doing in the James Geha case, or they clam up and refuse transparency as the NMAG is doing in the Taser / Schultz case.
How many more cases like this need to happen before someone responsible for holding these cretins accountable reaches down, and grows the set of balls needed to start charging the officials who betrayed public trust, got people killed, destroyed our city, and residually continue to prevent forward progress through rebuilding, like the viruses they are.
Folks, the damage done was so bad, and the indifference towards it is beyond comprehension, because selfish individuals do not consider it an issue. This is because it does not adversely affect them and their little worlds.
Unrepairable, willful, malicious, intentional, and criminal acts were committed by the previous administration and it is being permitted now by this one. Those responsible were allowed to run away to collect pensions, despite evidence they committed perjury, tampered with cases and witnesses, and defrauded courts. Many of them are now working in high paying jobs in other departments and cities. Ask yourself how many people get to wreck a city, then get rewarded or have other employers ignore their past?
That remains unanswered and that is unacceptable. A woman was found dead. That woman was exposing corrupt behavior. The scene was tampered with, and destroyed. It was intentional, and the stage was set from there. If the last ten years in not proof that this place needs to be dissected and disinfected with aggressive retroactive and proactive civil and criminal proceedings, then it is over.
The time for being pussies, and not cracking shit open, because of how involving and daunting it may be is over. The excuses of it being a never ending rabbit hole, is a betrayal to public trust, and the public’s hope in justice.
Everyone here is disgusted and sick to the point of being enraged about the lack of action.
It is time for federal monitor Ginger to recommend harsh action, and Judge Barak to call for an audit of everything APD for the last decade.

MARY HAN
The question remains. What happened to Civil Rights Attorney Mary Han after she dissolved her practice with former law partner Paul Kennedy, and the city maliciously desecrated the crime scene?
We all know that former Deputy Chief Allen Banks, along with a host of other dirtbags mishandled the crime scene at Mrs. Han's home in November of 2010, in such a way that if she were your family, and you were to see this disgraceful act of misconduct, nothing would stop you from throwing those responsible through the drywall.
Former New Mexico Attorney General Gary King stated that there was no definitive evidence that Mary Han took her life that day. He admitted the cause of death should be changed to "undetermined" after those involved in the investigation called it a suicide. Words like "meddled" and "no real investigation was done," "unfairly and unjustly labeled a suicide" were attached to this incident. The AG labeled the actions of those at the scene that day inexcusable, yet one was promoted to Chief, another is still the Chief Administrative Officer, and others got to retire with fat pensions. In other words, business as usual, and nothing was done.
Mary Han was found with a CO blood level of 84.8%. For her size that was impossible, much as is breaking your small toe by yourself, post mortem. Observing the crime scene, it's what's absent that more so tells the story, like the absence of exhaust condensation from her car, which was not running, or the presence of condensation from water vapor from the exhaust under the car. There was no puddling, or displacement of dust or dirt from condensation from the vehicle's tail pipe, and Mrs. Han did not have the symptoms of pink flushness in the face, as exhibited by carbon monoxide poisoning victims, as per AFD Commander Hiland.
On January 26th 2017, the 2nd phase of the Han family appeal to have Mary Han's case changed from a suicide to undetermined, or homicide took place, and two people, among others were present posting updates on Twitter; Reported Jolene Gutierrez Krueger, and Charles Arasim. The information posted about testimony from those accounts on that day was disturbing to say the least. Much of this hit the news, but in this case, more exposure is better.

In front of judge David Thompson, APD officer Tim Lonz describes how Paul Kennedy, who found Han was allowed to leave the scene, and return. This officer admits to being a friend of Deputy Chief Banks, and stated that he didn't want to see an email that was in a "file" in Mary's home "get out," so he called banks to the scene. Lonz then describes how the brass showed up, and everything went sideways and cloak and dagger, from there as they kicked him out, and took over the scene. Lonz described how Banks ordered him to violate a major crime scene rule; to protect the integrity of the crime scene, by ordering him to leave his own scene. This officer described how it was unusual for so many city officials to be on this scene, and how his request for a full crime scene call out was denied. Lonz stated that he did not know where the folder with the Banks's email went, and that Han's laptop was given to Paul Kennedy, who was allowed to leave the scene with these items.
Former APD officer Jacob Welch also testified, effectively pointing out what a true filth bag Allen Banks really is, as he described what he took as a threat, when Allen Banks told him at the crime scene that "Your testimony better match mine," concerning their actions, and observations that day. He also went on to describe in conflict to other testimony that Han was in what appeared to be a very uncomfortable position in the vehicle seat, where she was found.
Not only is there the question of what happened, but why did it happen? Why was this incident phoned in as an "accidental suicide" by Mrs. Han's former law partner, who is legal counsel to the Governor, and why was he allowed to leave the crime scene with key evidence that a rookie officer would have checked first for signs of foul play. A novice would have known to preserve those devices for evidence, like notes, emails or contacts last called on the phone, along with text messages? Why, to this day has he never been interviewed? Why was Rob Perry, and Kathryn Levy there, and why was Ray Schultz called on his cell phone, only for him to make further outgoing calls back from his wife's cell phone, as he was away?
Police, and city administrative officials kicked police officers out of their own crime scene... a crime scene involving a very prominent civil rights attorney, who was considered a thorn in their corrupt sides, and no questions are asked! No eyebrows are raised?!? Diamond jewelry, and files go missing and nobody asks questions? Yet.... the OMI, based on information gleaned from this disgraceful fiasco, and travesty can honestly deem this a suicide? We think not.
It is shocking that those responsible for this, like Allen Banks, can land a job as police chief in Round Rock Texas with this, and his lies involving the Perea case, and administrative issues and lies concerning the prisoner transport center that are well known, documented, and proven hanging over his milk dud head! Amazing, isn't it? And we have not even touched on the former crime lab head Mark Adam's nephew scandal, where he (mijo) was deemed unfit during the hiring phase for his job at the PTC, yet was hired anyway, and covered for by the brass like you would not believe. What is with this phenomenon of do as I sayers constantly lying under oath, and tampering with investigations, while getting a free pass on their behavior as if they were the opposite of disgusting human beings? This is not Iraq or ISIS occupied Syria. This is the United States where these punks are allowed to act like this. These filth are given weight because they attained a title or rank. They are protected because of what they know or have done for judges and politicians. Maybe this is the reason for some really peculiar rulings concerning cases close to this and the agendas of these criminals.
APD may not have been on trial on the 26th, but the decision OMI made based on what APD did, and did not do was. OMI made a decision based on no investigation, and out of control acts of an out of control, and corrupted administration, that deliberately fouled up a crime scene.
Now we will wait to see what this judge has to say. Meanwhile, the vermin who know exactly what happened get to live their pathetic, self centered lives, profiting from their cowardice, either in exile in other states, or here, sucking blood money. Meanwhile...

Going Out of State
It seems despite the best efforts of Martinez and Berry and those controlling them from the shadows, things that are of major significance to New Mexico are either staying away or leaving. And let's be real, what counts for "best" in our little backwater state is really just not that.

No shocker here (yes that was an Eye pun). Not only does the car not consume fossil fuels but the manufacturer is clearly NOT a Koch family friend. Well, duh, NM is only open for business for associates who donate to Martinez...leading to more martinezizing of the state. I mean really who wants a $5 Billion investment in the state? There was a lot of widespread reports that a federal magistrate judge's granting Berry/Perry's desire to see this case go away accomplished just that. Well folks, this case is now headed to Denver to the US Court of Appeals where it may be heard finally by a panel of judges from outside of New Mexico. We'll see what this means but for Berry and company, it means this matter is not going away. In articles published across the country by the AP, we found the closing paragraph on the case rather....eerie:
City officials have called the case frivolous but have not explained the highly irregular and suspicious circumstances involving APD’s botched investigation and contamination of the crime scene.

There was a lot of widespread reports that a federal magistrate judge's granting Berry/Perry's desire to see this case go away accomplished just that. Well folks, this case is now headed to Denver to the US Court of Appeals where it may be heard finally by a panel of judges from outside of New Mexico. We'll see what this means but for Berry and company, it means this matter is not going away. In articles published across the country by the AP, we found the closing paragraph on the case rather....eerie:
City officials have called the case frivolous but have not explained the highly irregular and suspicious circumstances involving APD’s botched investigation and contamination of the crime scene.

Our Eyes forwarded this excerpt from what we are told is an explosive segment of KNME's New Mexico In Focus that is going to be aired this evening.
You see, in the midst of all the protests and controversies involving APD, there's been a quiet but very dark shadow looming over the city's leadership. For those that don't remember, very prominent and outspoken civil rights and criminal defense lawyer Mary Han was found deceased on November 18, 2010. At that death scene, virtually all of then APD's brass and much of the city's civilian leadership showed up, flooded, and tampered with the scene so that no effective investigation could be done to determine what had happened. In fact, the allegations that department brass were so ghoulish in their behavior is only compounded by the fact that they were aided and abetted by the likes of current CAO Rob Perry and then Public Safety Director Darren White and their minions, TJ Wilham and Chris Huffman-Rameriz.
If you recall, in 2010 people were then calling for DOJ to investigate APD. Then upon Ms. Han's suspicious death, all reins on APD and Albuquerque seemed to break loose and now look at the mess we are in.
In this interview segment, we see that the family's attorney, Rosario Vega-Lynn is present, the chief counsel, David Pederson, for the NM Attorney General, and two former officers from APD: Thomas Grover (former APD sergeant and friend of Ms. Han) and Brian McCutcheon (former APD crime lab lieutenant).
Now we know the Susana'ites and haters will come out and try to justify or distract the happenings at the scene on November 18, 2010 by attacking those that dare speak out against the misconduct of those there at the scene.
Misconduct like, as we are told, the taking of cell phone images, trespassing, destroying evidence, tampering with evidence, and the mere presence of civilian personnel who had no business whatsoever at a crime scene. Perhaps Mr. Wilham could put the burr-eat-oh down and answer a few questions without breaking into a cold green sweat?

Criminal Conspiracy Defined: Raymond Schultz and Darren White

Our Eyes tell us that a "citizen's search warrant" is about to be served at APD's Main Station downtown. As seen from the picture below, it seems APD brass was tipped off and now has tampering with evidence among other chargeable offense.
In the midst of DOJ's investigation and the unfolding mess of TaserGate, the Eye began thinking about what exactly was it that Schultz, Berry, Perry, and White were so afraid of with DOJ coming in to do an investigation of APD.
Surely it's not the shooting of a few dozen citizens. For if it were, the brakes would've immediately been applied and special orders issued all but prohibiting the use of deadly force except but under the most extreme circumstances.
Well, it's quite obvious that Schultz, Berry, Perry, and White didn't want DOJ to investigate for things other than the shootings. They went so far as to defame and inflict horrendous violations upon their own personnel in their effort to "show" DOJ their presence wasn't needed when they fired former officers John Doyle and Rob Woolever. Now it seems that TaserGate is but the one of those concerns that Schultz really would've preferred not be exposed about. Makes us think about ARAPA and the placement of certain women in the days following Schultz's departure.
Over the last few days, your loveable Eye has been reviewing some of the more dramatic cases of APD misconduct to see what other issues there are besides the obvious matter. Clearly there is/was a serial killer on the loose in Albuquerque murdering prostitutes and burying them on the west mesa but nobody seemed to care. Obviously Tera Chavez was murdered and there is/was a giant stolen vehicle theft ring involving Levi Chavez and other APD officers. Then there is the matter of the suspicious death of prominent civil rights lawyer and APD foe, Mary Han.
You see, we've spent quite a bit of time reviewing the civil complaint, and we notice something that hasn't been brought up. While we all know there was a disgraceful and atrocious flooding of the death scene by APD and City brass, the communications amongst those persons seems to be overlooked. And where the lawsuit is in the courts is very interesting. The city's response has been to confirm that all the allegations in the complaint are true and move for dismissal because even with all the allegations true, there are no claims that any damages can be provided for. In other words they are saying, they don't dispute anything in the complaint.
Below is a chart showing as best as we can tell from the lawsuit the path by which phone calls occurred on that fateful day in November, 2010:
The boxes in red indicate personnel that were at the scene and went into the house. And the lines indicate phone calls between persons with the call direction show by the arrows. Notice how Ray Schultz and Darren White appear to the be the focus of so many communications? They are what one would call "hubs." It seems they were quite busy, and all this for a reported "accidental suicide?"
Notice how Banks appears to have been involved with personal property at the scene? And notice how Perry does not follow his chain of command and bypasses Schultz? And speaking of Schultz, where was he when this incident happened? News reports tell us he was out of state and in Michigan at his bereaving mother's side. But other Eyes tell us he was not in Michigan at all. Notice how White was contacting everybody under the sun, and bypassing the chain of command by calling Banks directly? We know we have many readers at Sandia National Labs, perhaps some of their communications specialist would care to weigh in. Because if when it comes to conspiracies, this speaks for itself, police calls come in and work their way up not their way down through the chains of city power. And all this for an alleged suicide?
We think not. We think this speaks for itself.

WE at the Eye have been saying for years that there is no better expression than "nature abhors a vacuum" to describe the risk city mayor RJ Berry, city CAO Rob Perry, and then APD chief Ray Schultz have put Albuquerque and the Albuquerque Police Department in for their unbridled abuse of power and corruption. And thanks to the local media's generally weak scrutiny of the city and it's beleaguered police department, there is a huge vacuum between how things are, and how they should be.
You see, nature has a way fixing things. It has a way of fixing the gap between what is just and unjust.
You cannot falsely justify or fabricate reasons to kill people by your police force without consequences.
You cannot cover up murders of opponents and outspoken civil rights advocates without consequences.
You cannot violate even your own police officer's civil rights and fabricate charges without
consequences.
While almost 18 months ago, the US Department of Justice announced their investigation into APD, it seems their investigation has evolved into one that includes disgraced chief Ray Schultz and the cronyism of RJ Berry and Rob Perry.
But now, an even more powerful force has entered into the fray thanks to the unbridled actions and failures of Albuquerque's leaders. Thanks to them, they have failed us. And now nature comes forward on March 30, 2014 to help make things right. The gap between what is just and unjust is about to brought to daylight.

Another APD Sergeant Speaks Out: "Where to begin????"

I know the media likes to play up the
"human waste disposal" angle, but being a APD sergeant I like it
that the officer used a gun he couldn't qualify with, thereby being
ordered not to carry that firearm. What are orders
anyway? Do officers actually have to obey orders? And if they don't
like an order can officers judge fudge and say they didn't know? Or
better yet just lie about it? Yep that Richard Berry has changed APD
for the better. He has really brought the standards
up. I mean what was the rule on untruthfulness before he was mayor?
Since Berry now allows officers to lie and keep their jobs the old rule
must have been if you lie you get 30 days free subscription to Southwest
Companions. I am not sure about that because
the city has never released any of the Southwest Companions documents.
But I trust Berry, he wouldn't hide anything. He is a most transparent
mayor.
By the way, APD doesn't need
the shooting range when officers have qualified on the streets of
Albuquerque. Qualify with guns, we don't need to qualify with no
stinking guns! (I think Sierra Madre is the movie).
I like it that the Kennedy Law
Firm family is making sure they will have an inheritance for their
children, paid for the citizens of Albuquerque. It makes it easier to
have an Albuquerque police settlement template that includes
the Kennedy Law Firm already listed. That way it speeds up just having
to add zero's to the payout total.
Will we ever hear anything from the
city or Kennedy law firm regarding Mary Han? What is that noise? Oh it
is the sound of crickets on a summer evening in Albuquerque? That is
all we will ever hear regarding Mary Han. Up
until the settlement check is sent. Oh but wait, back on December 20
2013 KOB reported that City Attorney David Tourek said the Mary Han case

Still waiting for the video of our
$30,000 pay raise CAO (we call him the Lone Perry and his side kick
Tonto-Wheeler). It was so nice to see him obstruct citizens at the city
council meeting. When politely asked to not kick
a camera he tells the citizen not to touch him. Oh so professional.
Of course Tonto-Wheeler is not going to stand for the Lone Perry being
singled out by a citizen. So Tonto-Wheeler goes into action in the
parking garage, letting the citizen know just who
the bosses are in this town. Of course we don't know exactly what

regarding Omaree Varela. Hey just who does KOAT think they are? Asking

KOAT want to know why the police report didn't make it to the DA? Or
why Crimes Against Children were not called out? KOAT needs to know
their place and go back to telling us who won Dancing

Banks Lies: AGAIN...
In the Spring of 2012 we broke the story about how then Deputy Chief, and now Chief of APD, Allen Banks was caught lying under oath during a cross examination by attorney Sam Bregman. Now, as the link below reveals, it is clear that not only is Allen Banks capable of lying under oath, but fully able to fabricate events AND hold himself to a clear and separate standard while disciplining others of the same violations.

While Banks confirms he was in a place he shouldn’t have been in, in the height of arrogance, he asserts he did nothing wrong. But the revelations offered by Banks get even more bizarre and sordid.
Mr. Banks confirms that he had a one-one conversation with a person who was arrested by then Officer Russell Perea for burglarizing Banks’ home. A one-one? Could Mr. Banks had said something intimidating and threatening to the person accused of breaking into his home? And did he just admit that he had this conversation while the person was handcuffed and contained in the back seat of a police car?
Our retired APD Eyes tell us that Mr. Banks may have just admitted to committing the crime of assault. And given the his position of authority Banks may have committed other felonious crimes.
And it gets worse.
In this audio, we hear Mr. Banks also confirm from his perspective what good police practices are and are not.
He states that it is ok for a department lieutenant to enter a suspicious death crime scene, tamper with evidence, and essentially run amok all while not documenting any of the actions in a police report.
Just like our Eyes tell us Allen Banks did at Ms. Han’s crime scene.
Mr. Banks would have us believe that it is ok for a senior figure in the state’s largest police department to enter a crime scene and not document their actions in a police report. Actions that Banks himself confirms would warrant discipline had a field officer committed such actions or inactions.
Our Eyes tell us that at one point, Mr. Banks was a field investigator in APD. As a field investigator, Mr. Banks is highly knowledgeable about how crime scenes are processed. For him to NOT comply with SOPs concerning his action is extremely disturbing and as a leading figure in the APD, truly models what can only be described as criminal behavior. In short, Banks cannot say he didn’t know what he was doing. His actions were the epitome of knowing and deliberate.
As Mr. Banks invites Mr. Bregman, maybe it’s time that somebody closely examines his history as a police officer. To enter the residence of a high profile adversary, to throw officers out, lock the door, and take pictures of her to show to your boss, Ray Schultz, that she is gone, is amongst the most repugnant actions we at the Eye have ever heard of an officer do in uniform.
It shows such a level of disrespect, it makes us wonder is there anything Mr. Banks would not do…..

Our retired APD Eyes tell us that Mr. Banks may have just admitted to committing the crime of assault. And given the his position of authority Banks may have committed other felonious crimes.
And it gets worse.
In this audio, we hear Mr. Banks also confirm from his perspective what good police practices are and are not.
He states that it is ok for a department lieutenant to enter a suspicious death crime scene, tamper with evidence, and essentially run amok all while not documenting any of the actions in a police report.
Just like our Eyes tell us Allen Banks did at Ms. Han’s crime scene.
Mr. Banks would have us believe that it is ok for a senior figure in the state’s largest police department to enter a crime scene and not document their actions in a police report. Actions that Banks himself confirms would warrant discipline had a field officer committed such actions or inactions.
Our Eyes tell us that at one point, Mr. Banks was a field investigator in APD. As a field investigator, Mr. Banks is highly knowledgeable about how crime scenes are processed. For him to NOT comply with SOPs concerning his action is extremely disturbing and as a leading figure in the APD, truly models what can only be described as criminal behavior. In short, Banks cannot say he didn’t know what he was doing. His actions were the epitome of knowing and deliberate.
As Mr. Banks invites Mr. Bregman, maybe it’s time that somebody closely examines his history as a police officer. To enter the residence of a high profile adversary, to throw officers out, lock the door, and take pictures of her to show to your boss, Ray Schultz, that she is gone, is amongst the most repugnant actions we at the Eye have ever heard of an officer do in uniform.
It shows such a level of disrespect, it makes us wonder is there anything Mr. Banks would not do…..

Mary Han Part III: Shades of White
"Darren White has long fought against shady deals, corruption, and ethics violations throughout his career – from Santa Fe to Albuquerque. Darren White will shake up the political bosses, shady lobbyists, and the traditional power-brokers in Washington, D.C., and promises to govern in an open and transparent manner."
Displayed herein is a chart showing all the connections between many of the high level players at Ms. Han's death. The thicker lines represent thicker relationships. As you can see, Kennedy and White have the most connections and the thickest connections.
The above statement came from Darren White and his campaign on October 15, 2008, prior to being beaten by then city councilor, and now U.S. Senator, Martin Heinrich. White made the remarks as then state senator pro-tem Manny Aragon plead guilty to charges of conspiracy and mail fraud in a public corruption case which brought down the once mighty politico.Were they too tempting of a trophy for the offenders?
Or were they articles of nostalgia for one boxed into a corner by years of nefarious actions, unrequited love and bold rejection?

New Mexico Attorney General's Report: Part 1
The release of an official findings report from the New Mexico Attorney General regarding the Albuquerque Police Department's response to the unattended death scene of successful civil rights attorney Mary Han once again brings the incident to the front page and lead story of local media.
And again APD makes national news of yet another failure so egregious, the department is known from coast to coast as one of the worst law enforcement agencies in the country.
Over the next few days we are going to scrutinize APD and the city's handling of this matter in thorough detail. As we have been routinely monitoring the initial incident, the department's response, the actions of high profile public and private persons, and more, we at the Eye are confident in saying this sad affair not only challenges the very legitimacy of APD, but many of the city and state's current leaders. Our Eyes have kept us updated since the date of the original incident and we have indeed made some all but certain and definitely relevant connections which occurred prior to November 18, 2010.
We start at the end however. Today we look at the city's (and defendant) and Bank's response to the AG's letter.
Instead of addressing any of the findings at all in the AG's report, APD's interim chief, Allen Banks jumped on creating a comparison between the AG and the FBI. Banks remarked that the FBI "did receive all the information."
Following up those statements came this response from the office of David Tourek, the city attorney for Albuquerque:
"Mary Han's death was investigated by the independent, professional and non-political state Office of the Medical Investigator, which was on scene and reached its own conclusion based on scientific findings. Our understanding is that the FBI was asked to review this case and found no evidence to support additional investigation.”

The New Mexico Attorney General functions as the state's chief legal officer and legal counsel to state government, consumer advocate, and guardian of the public's general interest. It has civil investigative divisions as well as criminal divisions and has jurisdiction state wide. It is staffed with attorneys and certified law enforcement officers. Regularly the NMAG is asked to review incidents or conduct its own investigations into high profile matters that are beyond the scope of the local agency or appear to need an objective review.
These review are commonly known as opinion and advisory letters. Citizens, towns, cities, counties and the state use these opinion letters to guide actions. Think of them as robust legal analysis that give one an almost certain idea of where an issues stands. This past Friday, the NMAG issued its objective and independent review of APD's handling of Ms. Han's death scene and the report confirmed much of what is already known: That APD deviated from standard law enforcement protocols, state SOPs, and internal SOPs that its actions were simply disgraceful. In fact the actions of APD and city leadership were described as “inappropriate,” “terribly mishandled,” “inexplicable,” and “fundamental police procedures for suspicious deaths were inexplicably not followed.”
What does this mean? It means that nothing that APD claims to be true at the scene, can be considered true.

When confronted with these findings, APD and the city of Albuquerque's leaders confirmed the report by simply not challenging it. They do what all people guilty of acts do, they attack the accuser. But in this case, the accuser are the people of New Mexico.

I'm kind of surprised and perplexed at the way the Attorney General sent out a news release and has not contacted the Albuquerque Police Department.”

We at the Eye find that answer bizarre. It sound like what many of our Eyes hear when they arrest an offender and that offender cries that the arrest is bad because some other offender got away with the same incident on another occasion. It doesn't even make sense. Perhaps Banks didn't understand that the FBI was working in conjunction with the NMAG?

This of course was in follow up to a statement by city lawyer, Kathy Levy on 11/9/12:

While we appreciate the science that technicians in the OMI are expected to use, by now we've all heard the disgusting biased sexist comments offered by the forensic pathologist who examined Ms. Han. Dr. Reichard may have forgotten about New Mexico, but we have not forgot about him...

In essence, Banks and the city have conceded to the higher authority of the NMAG. And they are attempting to distract us all by attacking the messenger. Which of course not only will backfire, but will make things much worse for them.
